@kitty, I know what you mean. Those expense did add up. But at this point, I guess it is worth the money to buy you calm and peace to know that he can call you.
I don't get all this process fees. Non of the normal credit card charges are going to need 8-10 dollars. It is just another scam of jail business!

@ Compassion4, it sure is a scam. I've had to deal with 3 other "phone companies", they all charged $6.95 processing fee. I'm going top call the jail tomorrow, if he is still there I will put the money in the bank and set up a phone account.

I put money on a phone account on 5/21. Talked to my son once that day. Did not hear from him Thursday (he was supposed to call and hang up when machine picked up, just so I know he's still there). He got a free call yesterday, he is now in Nevada. He has no idea where in Nevada, and the paper he had just says NEVSO. Can't find anything on line, can't set up yet another phone account until Tuesday (got to put money in the bank) and who knows how long he will be in Nevada. This time I can't even check to make sure he is still there before setting it up because I don't know where "there" is. Anyone have any ideas?

I agree, they should all just use the same phone company, or give options for different phone companies. If you think about it, these companies have a monopoly in the area they serve, no competition, they can pretty much charge what they want. If you had multiple companies in the same area, you'd have some competition and maybe better prices.

@ Compassion4, well, I found out where he is, Nevada Southern Detention Center. Of course they have a phone system that is none of the ones I already have an account with. So unfortunately, nothing I can do until Tuesday when the bank opens. But I will call to make sure he is still there before I open a phone account. I have a feeling he won't be. I have a feeling he will be in Montana by then. BUT AT LEAST I KNOW WHERE HE IS!!!

Kitty, i am glade you find out where he is at. It is hard not to have contact for couple of days. Keep us updated. Hope you can have a good long weekend since there is nothing more you can do at this moment. Recharge and wait till Tuesday.

He calls me every day just to let me know he is still there, he hangs up after answering machine picks up. This is our system, so I know where he is but we don't burn through the phone money. He calls back right away if he needs to talk to me and I answer that call.

Yes, this is common. Each of the states and the federal government are considered separate sovereigns. There is no double jeopardy for prosecuting a defendant for the precise same conduct in separate sovereigns. however it is usually state and federal concurrent prosecutions and not so much the different states. As a PRACTICAL (as opposed to LEGAL) matter, the state where he was arrested will hold primary jurisdiction and, provided he receives a sentence that the other state(s) believes is sufficient they will just drop the charges. To be sure, they do NOT need to, just they usually do to conserve resources.

Now, as far as another state getting jurisdiction merely because of any email, there is a sufficient body of case law indicating that merely sending an email to someone in another state is not in and of itself sufficient for that state court to exercise jurisdiction. So, I would not just assume that these other states have jurisdictions to prosecute him even if they do file charges. Regardless, assuming he does not have money to pay for private counsel he will be able to have court appointed counsel in any state (of federal district) that decides to prosecute him.

Allenbaughlaw, Thank you for replying to my post. You are correct, no money for a lawyer so he will have a public defender, as he did here. He was arrested here in New York State. He accepted a plea deal, guilty to 1 count of possession and distribution of CP. A few weeks before sentencing he was re-arrested because Montana issued an arrest warrant. The court here refused to send him to Montana until after his sentencing. He was sentenced on May 1st to 10 years in federal prison. Now he is on his way to Montana to face charges there. Apparently they are charging him with conspiracy, and asking the court for 15 years. He has gone from Ohio, to Oklahoma, to Nevada (this trip has taken a week, so far). His next stop should be Montana, but who knows. I was hoping they would drop the charges, but it doesn't look like they are. His lawyer here said if she had known about Montana before the plea deal was in place, she probably could have handled everything here.
Any advice would be greatly appreciated.

state and federal are two different entities and i'm pretty sure both can charge him without the double jeapordy coming into play but i may be wrong.

according to his lawyer any state where he emailed someone can charge him.

Today is not a good day! I am so angry and upset I just want to start throwing things. My son finally made it to Montana, he is currently being housed in a "classification pod" at the Missoula County Detention Center waiting to go to court (hasn't been assigned an attorney yet). He has been there since Thursday, no meds. They wont give him anything without his medical records from the doctor. He just called me in pain, his IBS is horrible. I called the facility, went from the woman who answered the phone to an Officer Tacket, to the medical department where I got to leave a message! Of all the facilities he has been in this one is the absolute worst! It doesn't matter how old they are, your children are you children. When they are in pain and there is nothing you can do, you can't even hug them, it is the worst feeling in the world.
