I got to talk to his lawyer today face to face, the charges are basically the same but the web site was different. He is being charged with conspiracy to distribute in Montana, here is was receiving and distributing. She also told the judge that if they NY state had known about the new charges before a plea agreement was in place they probably could have combined cases and kept everything here. She also told me that she thinks any time given by Montana will be served at the same time as time given by NY. She also said that she thinks the hardest thing for him in regards to Montana will be the fact of being away from here, and having access to his meds and food that he can actually eat.
I am glad to hear things (kind of) worked out well for your son. Best of luck to both of you.
He plans on fighting the conspiracy charges. I also pray they don't go overboard (after all, it's an election year) but who knows. Here his lawyer asked for less than 8 years due to all his issues and the fact that he is a first time offender, the prosecuting attorney wanted the max 20 years, but her office never responded to his lawyers plea for lesser time (judge was pissed at her office), so he kinda went middle road 10 years he said because first time offense (not so much as a parking ticket) and he showed true remorse for his actions. At this point fingers are crossed everything goes okay for him in Montana.
that's good to know, both sides won here that's for sure.
