My son is still in prison, but does want to return to Virginia. I am researching and researching other states that we could move to before he is released to make his life easier. Virginia has a life "sentence" on the registry as do many states and I understand he can petition to be removed after 15 years. But I am at my wits' end to try to find some place suitable. And the laws are changing all the time! He has 4 more years to serve. Thanks for any comments or recommendations.

Please note that the first set of rules is the standard rules of parole or probation for the state of Ohio. I will also list a second set of rules for those on sex offender probation as an addition to the standard rules of parole or probation.
I also want to point out the the conditions of parole/probation are tailored to meet the needs of each offender. Some conditions may be added to this list and some of the conditions mentioned here may not apply to all offenders. But this is an idea of what a parolee or probationer can expect.

Conditions of Supervision in Ohio
In consideration of having been granted supervision on __ / __ / __ , I agree to report to my supervising officer according to the instructions I have received and the following conditions:
1. I will obey federal, state and local laws and ordinances, including Chapter 2923. of the Revised Code relating to conduct involving firearms and other deadly weapons, and all orders, rules and regulations of ________________ County Common Pleas Court or the Department of Rehabilitation and Correction.
I agree to conduct myself as a responsible law abiding citizen. I understand that if I am convicted of a new felony offense while under Post Release Control, the Court may impose an additional prison term consecutive to any prison sentence imposed for the new felony offense.
2. I will always keep my supervising officer informed of my residence and place of employment. I will obtain permission from my supervising officer before changing my residence or my employment. I understand that if I am a releasee and abscond supervision, I may be prosecuted for the crime of escape,under section 2921.34 of the Revised Code.
3. I will not leave the State of Ohio without written permission of the Adult Parole Authority.
4. I will not enter the grounds of any correctional facility nor attempt to visit any prisoner without the written permission of my supervising officer. I will not communicate with any prisoner in any manner without obtaining permission from my supervising officer.
5. I will follow all orders verbal or written given to me by my supervising officer or other authorized representatives of the Court or the Department of Rehabilitation and Correction.
6. I will not purchase, possess, own, use or have under my control, any firearms, ammunition, dangerous ordinance or weapons, including chemical agents, electronic devices used to immobilize, pyrotechnics
and/or explosive devices.
7. I will not purchase, possess, use or have under my control any narcotic drug or other controlled substance or illegal drugs, including any instrument, device or other object used to administer drugs or to
prepare them for administration, unless it is lawfully prescribed for me by a licensed physician. I agree to inform my supervising officer promptly of any such prescription and I agree to submit to drug testing if required by the Adult Parole Authority.
8. I will report any arrest, citation of a violation of the law, conviction or any other contact with a law enforcement officer to my supervising officer no later than the next business day. I will not enter into any agreement or other arrangement with any law enforcement agency which might place me in the position of violating any law or condition of my supervision, unless I have obtained permission in writing from the Adult Parole Authority, or from the Court.
9. I agree to a search, without warrant, of my person, my motor vehicle, or my place of residence by a supervising officer or other authorized representative of the Department of Rehabilitation and Correction
at any time. Notice: Pursuant to section 2967.131 of the Revised Code, Officers of the Adult Parole
Authority may conduct warrantless searches of your person, your place of residence, your personal property, or any property which you have been given permission to use if they have reasonable grounds to believe that you are not abiding by the law or terms and conditions of your supervision.
10. I agree to sign a release of confidential information from any public or private agency if requested to do so by a supervising officer.
11. I agree not to associate with persons having a criminal background and/or persons who may have gang affiliation, or who could influence me to engage in criminal activity, without the prior permission of my supervising officer.
12. I agree to comply with all financial obligations, including child support and/or supervision fees as ordered by any court and/or the Department of Rehabilitation and Correction.
13. I agree to give all information regarding my financial status to assist in determining my ability to pay specific financial obligations, to my supervising officer.
14. I agree to follow all rules and regulations of treatment facilities or programs of any type in which I am placed or ordered to attend while under the jurisdiction of the Court, and/or Department of Rehabilitation
and Correction.
15. I agree to fully participate in, and successfully complete, the following indicated Sanctions/Special conditions:

I agree and understand that if I am arrested in any other state or territory of the United States or in any foreign country, my signature as witnessed at the end of the page will be deemed to be a waiver of extradition and that no other formalities will be required for an authorized agent of the State of Ohio to bring about my return to this state.
I understand that I am required to pay the Financial Obligations listed. Failure to do so will negate any eligibility for an early termination of supervision and result in civil suit by the Attorney General’s Office

___ I will not possess or use cameras, video cameras, or other photographic equipment without the knowledge and permission of my supervising officer.
___ I will not possess or use a computer modem without the knowledge and permission of my supervising officer.
___ I will not possess any binding restraints.
___ I will not possess any law enforcement identification, insignia, badges, uniforms, or other items
associated with law enforcement.
___ I will not drive a motor vehicle with females without the knowledge and permission of my supervising
officer.
___ I will inform all persons with whom I have a significant relationship of my offending history.
___ I will inform my employer of my offending history if instructed to do by my supervising officer.
___ I will not have sexual contact with anyone without the knowledge and permission of my supervising
officer.
___ I will not use alcohol or any other drug or mind-altering substance.
___ I will abide by a daily curfew from _________ to _________ at my approved residence.
Additional special conditions:
MONITORED TIME CONDITIONS OF SUPERVISION
I understand that monitored time supervision has been imposed as a result of my conviction(s) . While I am on monitored time supervision, I remain under the jurisdiction and control of the releasing authority and/or the Adult Parole Authority. My supervising officer has the power to arrest me if I violate any of the following conditions of supervision and to supervise me more closely or to impose other sanctions for violations:

I will obtain permission from my supervising officer prior to leaving the State of Ohio. I also must receive advance approval before I leave Ohio if I intend to relocate to another state. My failure to obtain permission from the other state through my supervising officer may result in my arrest and conviction ofa felony in that state.
I understand that travel to any jurisdiction which requires felons to register with local authorities will also require me to comply with those laws.
As you can see, probation/parole for sex offenders is very intrusive and strict.

SC has the Adam Walsh law ( which is stupid as it takes away a decent tiering system SC used to have ) I came from NJ where I had CSL. CSL was made law in 1994 and was not punishment, was supervision only and only while in NJ ) I was locked up in 2004 when they changed it and enacted the Interstate Compact ) So I get treated like I am on probation even though I legally am not. Anyway, SC is not horrible if you are just a SO. NC is bad, everywhere below SC is bad. As others have said , the fake bible belt is horrible in general.
If the victim is under 13, reg. every 90 days, costs $150 yr. I think it is 6 months for over 13. ( still $150 ) Can't live within 1000ft of school, daycare, and parks. Plenty of places to live that are not bad but getting work is hard. I have many skills but can't get hired. Have been self employed for a long time so no big deal but health problems make it hard to pay bills now. SC did not expand medicaid so no insurance payment help if you make less than 12,700/yr.
If you are on probation or parole, things get worse. 1000ft of most places a kid might congregate. No parks, schools, mall or 1000ft. of any of those properties. There are a bunch of store near the main road in my town but it is all considered mall property so can't go. ( the mall is 2-3000 ft back from the road. I have had problems on ebay due to people looking up my name and trying to use my crime ( 20 years ago ) to cheat me. If I don't die first, I want to move when I get off the CSL crap in a few years. I wanted to go to PR but that seems over. It looks like Mass. and OR are decent. Hawaii doesn't seem bad but will be more costly than the mainland. The midwest and south are bad. If you are not on supervision, SC is ok but not great. The worst part is the adam walsh law. ( lifetime reg. for victim under 13 and a ton of other limits for no useful reason ) Hope that helps.

I saw your post earlier, so I contacted a guy I know in Oregon. He said it is one of the best states for sex offenders, but that the cost of living is rather expensive.

Actually recidivism for sex offenses is quite low for most types of sex offense. That is part of the reason these laws are so dumb. Aprrox. 80-85% ( depending on which stat you pull from ) of crimes against children are 1st time offenders. Around that same 85% are from friends or family. The recidivism rate for non-force ( most of the crimes against kids ) is around 4-7% depending on which study. Rapists ( child or adult victim ) is higher at 15ish percent. A true pedophile ( primary sexual interest is in kids ) are at a higher rate of 20-25% ( again depending on study ) Every state has civil commitment laws so most multi-time offenders are civilly committed after serving the sentence. So Megan's law at most protects the 4-15% of the 15% that are not 1st time offenders. Too many places justify these arcane laws with false information. Sex Offenders have the LOWEST recidivism rate of all Felons EXCEPT Murderers. Every other type of Felony has a higher rate of re-offense except murder, yet we are the only ones on a registry. DUI is multi-multi offenses, no registry. Drug sellers, same thing. 2 things that get sympathy for politicians, puppies and kids. I was locked up with a cop who should have gotten 7 years ( the typical sentence for his crime ), he got 6 months and lost his pension.( and bitched about that ) Arrests are big business in America, the area I was from in NJ had very little manufacturing, except locking people up.
Many stats show arrests or crimes not a SO as part of the stats. That is not recidivism. In NJ and here in SC, Child support is the main reason people get locked back up. They may have 3 jobs, working 70 hours per week, but once they get a certain amount behind they get locked back up and lose their jobs, and the cycle continues. Please don't help the crooked politicians enact more stupid laws but carrying the narrative that we have a high recidivism rate. Also, most crimes against kids are not by actual Pedophiles. Having a kid victim does not by itself make anyone a pedophile. If their PRIMARY interest is kids, then yes a pedophile. Way too many people throw that tag around improperly and it matters. You can't cure pedophilia, your interest is your interest, you can fix people who make bad or uniformed decisions that act on their distortions. Find the underlying cause of the distortion and inform them of the correct beliefs they should have and the majority do not re-offend. It is "behavior modification" based on the Minnesota model for rehab. Most people are not bad by nature, they have to justify why they do what they do. In non-force cases it is highly successful to modify the underlying beliefs and correct them to be healthy and normal and good. Some people can't be fixed, it depends on the person and their willingness to change. Most can. These laws add stress to an already stressful situation ( being a SO in bottom of the rungs ) so if society really wants to be safe, stop making our lives miserable so we have a reason to do good. Some just give up from all the crap they deal with and figure prison is better than free when free is so horrible. I know a couple long timers who committed new crimes just to go back to where they knew how to survive b/c they couldn't when they got out.

Do you know how they classify tier ? in SC it is by Adam Walsh law which is circumstance of crime only( even if clean since and was 20 years ago ) where NJ has a formula based on answers to questions and based on crime. Tier 3 here, Tier 1 in NJ due to difference in how they calculate it.

They are not using the SORNA classification procedure since SORNA classification is based on the nature of the offense.
Oregon is or has recently implemented a tier classification level based on a risk assessment score.

Unfortunately all the states that use it don't use it correctly but it is wayyyy better than the Adam Walsh Law way where the age and level of contact are the only factors and that tier is yours for life. A 1st or 2nd degree charge with a person under 13 gets you a TIER 3 forever. It doesn't matter if it was forced or not, none of the conditions matter except age and contact level.
Thanks for the info. I can't go anywhere for a few years but it is too hot here for me and the lack of health insurance and being on the internet after 12 years after release and will never get off it.
Oklahoma has residency restrictions and buffer zones. A registrant cannot live within 1,000 feet of a school, park, playground, daycare center, etc. In two of its largest cities---Oklahoma City and Tulsa----these restrictions are so burdensome that very few sex offenders can find a place to live.
If you can find a rural area or a smaller town, the residency restrictions are not a problem.
They also have buffer zones, which prevent a registrant for loitering too close to a school. A registrant cannot loiter within 500 feet of schools, parks, playground, daycare centers, etc.
If you have children in school, your guy will have restrictions if he wants to go to a school function.
Oklahoma also has a law preventing a registrant whose crime was against a child from living with minors; however, a registrant can live with a minor child if “the person is the parent, stepparent or grandparent of the minor child and the minor child was not the victim of the offense for which the person is required to register.”
Oklahoma has tier levels to classify registrants. Your guy will also most likely be classified as a “habitual” or “aggravated” offender since his date of conviction is so recent.
Oklahoma will also stamp the word “sex offender” in red on the face of his driver’s license. The fact that I had to go to the DVM and get my license updated every year----as SOs are required to do----was stressful.
Oklahoma does not perform very many compliance checks and the cost of living is cheap. Another good point is that the Oklahoma legislature has almost stopped passing laws against sex offenders. They got burned bad with the Starkey decision and no longer pass the number of laws they formerly did.
While the cost of living is cheap, there are very few decent paying jobs in Oklahoma, and the economy is shot.
I stayed in Oklahoma b/c my family was here and I needed to be close to my parents who were getting older. I live in a rural area, all my kids have left home, and I am semi-retired, so the registry did not bother me too much.
To get past the residency restrictions and to get away from all the crazies, I bought eight acres of land in a rural area and had a new mobile home placed in the middle of the property. I love the area as it is peaceful, but I stay at home most of the time.
I live out here with all my animals---seven cats and a dog---and nobody has ever bothered me. In fact, people have never bothered me since my release from prison.

In all my research, Oregon is the best state for sex offenders, although the one contact I have out there tells me that the cost of living is expensive.
