If she is a heavy addict and smokes around the house putting the kids in danger, get her out.
If she is a heavy addict who smokes outside and is just a mess inside but causeing no harm, then help her get out or get help some way or another.
If she is a moderate smoker in the house, throw her out to smoke outside, if she refuses call the cops
If she is a moderate smoker outside let her be, start the divorce and go along the merry little way.
Like I said, if the kid is in danger or exposed to the drugs she needs to be out for the kids sake. If the kid is in no danger, watch and protect the child and start the process of the divorce and ask the judge to remove the woman from the house and or seek treatment.
No one deserves to be thrown out on the street over disagreements unless someone is in jeopardy.

if she won't go...get her out...and if ever she wants to get help...help her...
be there for her when she needs you ...but don't put cash in her hands..or else its like you buying the dope...
Like drugs or not, opinions on mariguana aside, a good chunck of the country smokes it. The courts in most states simply aren't going to take the kids away from her for smoking.
Being a neglectful parent, is another matter. And That's the KEY issue here. If she's stoned all day long, then she's not being a parent.
If nobody666 was just getting upset about casual use that he had lived with for years, then I'd see this as a different issue.
As to her drug use: If her addiction is new, I'd give her a chance to go to recovery and get off it. If this has been a growing problem over the years....then he's better off just skipping that. But it's still worth it to try to get her into counseling, and it will look good in the divorce, and Child custody battles that may be ahead.
BUT dispite what everyone says about not tollerating someone else's drug behavior....you just can't control that. You can only control yourself.
So Document, use the 1K for babysitting when you're not able to be there, and document that too. NONE of this will go on your word, or your counselor's opinion. It's tough to prove neglect.
You might just do better to wait for a court date and for her to show up stoned....judges just Love that.
