But.... that being said, here is my opinion :P
If you enjoy his company, and it makes you happy to be with him, then do it. But keep your wits, don't expect him to stick around for forever, and understand you may end up heartbroken if your expectations are high.
Most broken hearts heal, nothing wrong with living in the moment. Especially if it makes you happy.
No one here knows the dude. Do what you want.
Although I'd give that one a miss if I were you.

That is nothing if not avoidance of commitment, and fairly straightforward at that. I know this is a cliche, but I believe it holds that status for a reason: Actions speak louder than words. He can be sweet, text you, and say the kindest things he wants, but if he is unwilling to follow through with the logical conclusion to exchanging such words (i.e.: exclusivity), then that may be all you need to know.
Also, he says he hates her? He is obviously still emotionally engaged with the woman, one way or another (probably not love, but still intense emotions nonetheless). Another red flag. I would steer clear myself.
Getting defensive = feeling guilty. He doesn't want to give what you want him to give you, plain and simple. He just wants to "have fun".
To preserve respect for you, I'd tell him to call you when he feels like making a commitment to you. You shouldn't settle for anything less than your heart really wants. In the end, you will have wasted so much time jumping through hoops to pretend that you are happy with HIS decision.
The moment you put your desires and needs aside to keep a man, is the moment you lose entire respect from that man. So hold your ground, and a real man will respect you more than if you didn't. If he doesn't, he's a SLEEZER! :)
I think this would be a good question to ask him....Why are him and his wife divorcing? If you don't know already, I think it would be pretty important for you to know. Don't ya think?
