Probably, though I don't know for sure, I'm guessing there will be a jury.. depending on his attorney, he may or not go up to the stand... he may also be at the other end of a closed circuit tv...sadly there are a lot of variables in any trial..
age of victim( both then and now)...what happened, how many times, pictures, or videos or recordings..( if any)..
and sadly the list goes on and on...
including witnesses for both your side, and his..
it can be hard, and a lot of mean things can be said back and forth...including his attorney blaming the victim ( no matter the age) that they came in to his client, ( dumb I know) ...

I didn't say any of this to scare you... I really hope I didn't...not my intentions at all...

Is there a victim advocate for the court? Are you involved with any of that?? Ask the detective(s) if there is anyone for the victim to help support during all this...

It honestly all depends. If it is a criminal matter your daughter may have to testify.

And as notalone said, I would highly suggest you speaking with a victim's advocate. People are not usually on rape victim's side, no matter the age. No one here can tell you how your specific case will play out, and neither can the attorney. But, they should be able to answer the more basic questions.

How did it get jumped straight to a trial? There was no prelim?

Like you literally had no hearing at all? It was just a straight jump to a trial? And what are the charges against the perpetrator?

There was a preliminary, it's been almost 2 years since it's happened but it's happening in a different state than where I live so I only hear the basics.
She was 5 at the time and does have to testify against him. The district attorney and the detectives are all on her side.
I'm not sure if the exact charges yet, again they pretty much just update me on dates and what his lawyer is trying to pull.
