Yikes. Sadly, this is a distinct possibility. Not knowing which state, is this a "right to work" state or not? If there is an employment contract that your dad signed, maybe that can help. Prayers that this all works out.

We are in Ohio. I dont think we are one of those states but I could be wrong. He just started a major project with the company this week that was going to pay a large amount. I guess that wont be happening now. :(

As of May 2013 Ohio was not a right to work state according to what I found. They tried but it was killed in the senate. So sorry he is going through that.

PA is a right to work state, but when hubby lost his job because someone reported that he had a felony and he does not, he won his appeal for unemployment. So. there are certain protections, even for that.

oh ok. I thought it was the other way around. He is thinking about fighting for an acquittal. If he were to do that and lose would he go to jail?

If they have the evidence against him that you have mentioned, it is suicide to go to trial. Yes, a conviction at trial would most certainly result in a prison term. I thought at one time you mentioned that they found CP on his computer.

These kind of cases----internet child porn cases----are next to impossible to win at trial.

On 9/17 you posted that they made a deal which stipulated he would get probation instead of prison. Now he is talking about an acquittal??????

Unless all the evidence was thrown out and ruled inadmissible, he will not win an acquittal. He just won't. If he has a deal for probation, he had better take the deal, as that is the best he can do.

Of course, I don't know all the facts of the case, but it sounds as if he should mitigate the damage, cut his losses, take one day at a time, and get on with his life.

Quit thinking about winning an acquittal. It won't happen.

I am telling you this not to sound harsh or mean, but I don't want your father to go to trial and get so much time that he will be a very old man when he gets out of prison.

Good advice Rew and its all to much a real possibility. Someone thinks that there is no way that they can lose then the judge hands down a lengthy prison sentence. After a real fair plea deal was offered.

That is exactly what I was thinking. It doesn't seem worth it. But in his eyes it is. He will lose his job and he feels the community will be almost as dangerous as jail. He doesn't want to be labeled. He feels his life is over already.

Look at it this way-----your dad can go to trial and be found guilty and get maybe ten to twenty years in prison OR he can accept the guilty plea and stay out of jail. He will have a conviction either way, so he can have one with substantial prison time or one with probation.

Surely his attorney is not advising him to go to trail????

Principles are nice, but if he is truly innocent and he is waiting for the American criminal justice system to be fair and see their mistake and see that he is innocent, he is in for a rude awakening. These people are ruthless. Don't think that the justice system will see the mistake and free him.

Today he asked his boss if he should be looking for a new job and he said they would talk about it tomorrow. His boss knows everything that has happened. I don't understand why it's suddenly a problem. So frustrating.

I've told him I don't think he should go to trial. So I don't think he will.
