We were lucky that I was able to pay off my husband's fines before he was released. Makes it easier now that he is living on a very small fixed income.
As a family we are covering his attorney fees and helping his wife...but are nervous as far as what and how much they are expecting him to pay.

This is once again...another aspect in this process that is unbeknown until your're faced with it...on top of everything else you're dealing with.
He has been in almost 7yrs of his 15yr sentence.
He and we (his mother & I), have been slowly paying it down.
We just made the final payment a few weeks ago.
Since he is still in prison, we have no idea what the OTHER costs will be once he is out.
So let me get this straight...the adage that we as citizens are paying for the incarcerated is pretty much false.
We have been responsible for my nephews toothbrush, hair brush, shaving cream, phone calls, and everything else thru the commissary from now til whenever.
Not to mention the fact when he's been transported to different facilities not one item is transferred. (Not even his personal pictures or letters).
My heart goes out to those incarcerated who have no family or any financial means to help them out.
It's never ending and I'm becoming more and more saddened and disgusted with this process.
Sorry for the vent...I know you are all feeling your own frustrations as well.

Many times cost of court fees and restitution are added when the subject (perpetrator) is convicted.
I am sorry that your having to pay for this... I have always said "It's All About The Money!"

I don't know if that is the only case or if it has been challenged in any other court. Aladdin could tell you as he is much better at sex offender legislation and court decisions than I am.

As for fines and fees,
He will most DEFINITELY have fines to pay after conviction, count on it, the amount will count on the severity of the conviction. I don't know his charges(and it's not my business), but If it is CP and there are images of certain victims, restitution could be ordered.
He WILL have parole/probation fees and if they are not paid it COULD result in a violation but they'd rather have the money. It's all about money.
SOR fees depend on the State. Some don't have them, BUT the registration authority, ie, County/City may.
I don't know about the 401K, BUT, I would err on the side of caution and use it to pay his legal fees, just in case.
I do know that any outstanding debt to the State of Feds will be taken from any tax refunds until paid, and interest WILL be added.
