Everyone my daughter is the victim, she's not the alleged victim, but is the victim because my husband did admit to doing it. I have been in contact with my husband's attorney from day one and I have told her what the prosecuting attorney had said to me. we discussed it and she says it's a good thing for my husband. Although I am still kind of leery of what she has said to me I still don't understand the 3 to 5 years if there is a charge that has a minimum term of 15 years of life.
I wish I could afford an attorney for both me and my daughter however I am a single mother right now with four children. I hope that something good comes out of his court hearing today with both the prosecuting attorney and his defense
Sorry that we all jumped over you not talking to the DA, we just want everyone to know you can't trust the DA, they don't have your best interest at heart. However, if your hubby's attorney said to do so she must have a good reason for it and I would listen to her.
I think the 15 to life was only added as a scare tactic to get him to plea for a much lesser amount. As Independent mentioned, DAs make their living stacking charges and then allowing a person to plea to a reduced sentence for a term they should have received in the first place.
It is the "LIFE" in the 15 to life that scares the hell out of defendants.
If he can get a 3 to 5 year sentence, he had better take it and run. That is a good deal.

The DA doesn't work for anyone but themselves and their own belt notching activities. The fact that she essentially threatened you with that 15-life, even if it didn't feel like a threat, that just indicates how good she is at her job. She called you up, asking you questions hoping to either bolster her case, be able to garner a new charge out of it to use as leverage, etc... This is not the kind of behavior of someone that is trustworthy or honorable.
The fact that your husband's attorney didn't suggest you have your own attorney is not looking all that good on her part either. Even if she knows the ins and outs of the DA's office, she doesn't work for them anymore, even if she feels compelled to have 'good relations' with them because she worked there. She should also know better that all witnesses, including those with the best intentions can do irrecoverable harm to a defendants case even with the most minor things that can be said and interpreted.
That DA called you up and threatened you and your family. Your husband's defense attorney seemed to condone it... This scares me for you....
If they try to push this to trial, know your rights, as they do not care about your daughter. My daughter suffered more testifing than the abuse she suffered from hubby.

totally and completely agree with these 2 statements, but i would add "families" to Rew's statement.
Having a lawyer for your daughter at least helps her be heard by the prosecutor.
You want what your daughter wants - you need someone who will fight for her on the legal side of things. Please, just get a consult, but if it heads to trial - GET AN ATTORNEY! I cannot stress this enough. They tried to take my kids for fighting what daughter wanted.
Attorneys can not be trusted unless YOU are the one paying them, even then it is sketchy. Anyone that says they work for you because you pay taxes is lying to you outright. Probably best to walk away from them as fast as you can.
That DA was fishing, the husband's attorney has essentially given up defending or they would be talking to you and your daughter about representation. The fact that they didn't only makes me more suspicious of their motives and intentions. They don't care about your family, if you think they do, look around at holidays and when you are in dire straits later on for whatever reason, if they were friends and cared about you and your family they would be there, and I can tell you right now, they won't be.
And whether this goes to trial or not, there is still a sentencing hearing that will happen, here is when NO MATTER WHAT THE PLEA AGREEMENT IS, the judge will do whatever they want. The prosecution will use whatever information they have gathered to make the judge pick the number they want. this means anything you said and will say to them can be used however out of context they like as it is only what was said, not the context in which they were said that matters in court, both of law and public opinion.
The only card left to play is to play nicely with the DA and try to bargain for the best sentence possible.
The whole thing still seems scuzy
