Yes, they may make him a 2. My charge was possession, like you son. PA said it was some crazy " Sexual Performances of a Minor" thing. I didn't care since either way it was a 10 year registration. Now, I would fight it like hell! Tier 1 is 15 years with a chance to get off in 10. Tier 2 is 25 years period!!.
Do not let him register in Florida. They will make him lifetime. PA will also make him lifetime, Tier 3, because they will use the Florida registration period.
Pick him up. Drive like the wind. Get out of Florida!!!
Now, if he vacations in Florida later and registers, when he gets off the PA registry, he will still be on the Florida registry until sometime after he dies. Florida does not honor other state's registration periods. I think it is a breach of interstate contract law. But, what do I know.
I asked the Feds about a Federal registration process. They said there is none! You register with the state and that's it. Are Wisconsin Feds different?
Also, since I was never Tiered under the AWA, strangely I don't fall into the AWA registration periods. The state will not register me now since, as far as they are concerned, I am done. They sent me an official letter to that effect.
"SORNA does not require jurisdictions to locate and register sex offenders who have entirely left the justice system"
There is no actual, separate federal registry. The federal "registry" only takes the information from each individual state's registry to create their so-called registry.
If a person is convicted of a federal crime, he or she registers in the state they lived at the time. If a person was convicted federally of cp in Kansas, they would appear on the Kansas registry. They will also appear on any federal government web site which lists sex offenders, but they register in Kansas according to Kansas rules.
The federal registry gets all its information from the individual states. If for some reason, a person was removed from the state registry, he would also be removed from any registry operated by the federal government.
There is no place to register for a "federal" registry and no registration process for the simple reason there is no federal registry. A registrant registers with the state and the feds copy all that information from to state registry to create their registry.
Sure, a federal agency may have its own web site that has a registrants data, but that data is obtained from the state.
It is much like the registries you see that are maintained by local police and sheriff's departments on their web site. Their information usually re-directs to the state registry.
All the information is collected by the individual states. Any other registry other than the state sponsored registry is only the data which has been obtained by the state registry.

I could only hope, even if he is put on tier 2, that get could get 25 years instead of life on the registry. We'll know soon enough. He gets out in 10 days and then all this crap will start happening. I'll keep you posted.
Couldn't have explained it better.
Nakohichi,
I hope he does get around the lifetime in PA. My Federal sentencing simply said I was to follow all local laws upon release. Also, let me know who his PO is. It's been 11 years, but they may still be there.
