You may need to look at these guidelines again before you appeal the denial. Look at how exactly you are impaired physically and mentally from doing even light sedentary work.

In my case, I had pretty extensive physical limitations and I went to voc rehab and couldn't find any other work that I could do due to pain.

Have you had a cognitive function assessment? By a neuro? They're long and draining but usually if you're suffering the brain drain it can help.

In any case, I agree about getting a lawyer---and any agency from A to Z. I was shocked by how much help United Way gave on the ACA and I am swimming in twice the health care coverage at half the cost with their advice and help so.... you never know where help'll come from.

Definitely get a lawyer. They take a percentage of your back pay and they only get paid if you win.

Don't hire a random lawyer though - find one who specializes in Social Security cases and get some references before you commit.

All they do is SSDI and Allsup only charges a fee if they obtain Social Security Disability insurance benefits for you.

Thanks everyone. They seem to have also ignored the records from my new PCP. I had been trying to find a lawyer, without any luck. I saw the PCP and he told me that people with emotional problems go to the head of the line. So I'm thinking maybe there are therapist who deal particularly with people with brain fog/pain issues.

I just went on vacation in Florida with the help of prednisone and had a quiet but great time. When I got home I found the denial letter. Now I'm crashing and burning just from the exertion of the vacation and coming off the prednisone. I can barely keep my eyes open, so I'm way too tired to be freaking out. The PCP doubled my dose of Klonopin, so if I start to freak, I have meds. Maybe tomorrow I can start calling social services to see if there is a way to avoid moving into my car.

You need the details in your medical records of how your impairments prevent you from doing daily activities and other things. It can't just say patient is extremely fatigued. Having applied online has nothng to do with the denial. It appears that your medical records didn't have the details needed or SSA didn't receive them. DId you call your caseworker and verify that they received all of the medical records they requested ? Did you send all the medical records of appointments that you had after they requested your medical records to your caseworker ? It isn't having an impairment, it is the severity of that impairment and the direct connection between it and you not being able to do any jobs in the national economy.

If you decide to appeal or to file a new application, get a copy of your medical records from each appointment after the appointment instead of waiting to get a bunch at once. That way you can discuss with your dr the things he isn't writting down or isn't writting down correctly.

I've looked a little into the rules in NY. They have done away with "reconsideration." So that isn't an option. Also, it appears that my eligibility for disability ended on 3/31/14. So I can't reapply. I have to wait for a hearing. Also, apparently the time to get an hearing is A YEAR.

I don't know how long I can even manage to have a roof over my head. I'm pretty much in despair.

A question I have though if any knows is I can get regular social security in 6 months when I"m 62. If I take that (it will be a pittance), can I still have a disability hearing? Or do I somehow have to live a year on no money in order to receive disability. I can't believe what a cruel process this is.

Is what you applied for Social Security disability? If so have you checked to see what your disability benefit would be? My disability benefit has tracked along with my retirement benefit for a while now, to the point that right now it's exactly the same.

You might find it's less hassle to just go ahead and take your retirement benefit. The math is different for each person as it depends on how many quarters you worked and the amount of your income. The difference in my benefit if I had taken it at 62 would be about $400/month less than my full retirement benefit at 66, but that is different for each person.

I'm pretty sure you can't draw both, and once you start your "regular" Social Security there are only limited circumstances and windows where you can suspend payments or withdraw your application - these are questions it might be worth a trip to your local Social Security office to get answered.

My understanding is that age 62 I automatically go to Social Security and SSDI stops. You might be better off to just take Social Security in 6 months rather than waiting for an SSDI hearing. I would go to a Social Security office with a list of questions so you can figure out what is best for you. Take care.

I believe the benefit converts at full retirement age, but your SS office can answer the questions for sure.

If you're receiving SSDI, it converts to retirement at full retirement age.
