I have to tell you that if you would have told that sad and disgusting story to anyone other than the members of this group, you would be deemed a liar and someone who is in denial for your brother.
But I believe you, and I believe every word of your story. I will not go into detail, but much the same thing happened to me. I refused to plea bargain, went to trial, and I received a 20 year sentence for absolutely nothing--absolutely nothing; there are similarities with your story and mine.
You are correct, the prosecutors in so many of these cases refuse to drop the charges even in the light of overwhelming evidence that the child is lying. Nothing will stop these "hired guns" until they get a conviction, and it doesn't matter to them who they hurt or even if the defendant is innocent.
I grew up in the late 1960's and it is still hard for me to believe that such injustices happen in this once great country. I don't know where the America that I once knew went, but it is no more.
The thing that is the hardest to swallow is that our cases were not just a matter of unfortunate circumstances beyond anyone's control. No, they were the direct cause of a bunch of lying policeman and a prosecutor who was nothing short of a monster.
The prosecutor will get his conviction come hell or high water.
I hope that you and your family can someday find some peace and meaning in all this madness. Until then, Convicted2011, hang in there and keep your head high.

I'm so sorry to hear this tale of yours....the system is so unbalanced it is crazy!! Your brother did not have a chance, even with supporting evidence that clearly, if viewed with a unbiased eye, would show his innocence in this matter. I have a couple of questions: you said after 4yrs waiting for trial--I'm supposing he was jailed all of those yrs? If so, those WILL come off his original sentence, and also, if he is Federally incarcerated, he must serve 85% of his time. In my son's case, he was sentenced to 180months (15yrs.)--so, with no hiccups during his incarceration ( he is in a Federal low facillity in Mississippi!!), his total sentence would be 12yrs, 8months minus time served. He has been in for a little over 3yrs, so yes 9 more to go. Is your brother in the state of FL, or did the Feds, in their SUPREME INFINITE WISDOM( yes, being sarcastic)...send him 3 states away like my son. FYI--did the 11hr drive to MS to see my son, there was a lady there waiting to see her son..and she lives in New Mexico, where her son was convicted!! Totally absurd!!...Anyway, good luck & God bless to all of you..

Jim, I am sorry your son is so very far, I dont know how I would deal with that.
There's such a fine line that is walked in these cases. It sounds like the punitive justice system is at it again. Your brother is the victim this time. I am so sorry.
I too have a brother who took a PLEA.( lawyers advice) He is 4 yrs younger and I have always looked out for him and since our mom died 7 yrs ago I guess I took her place too. Actually, I think we just lean on each other more. We are not young by any means(I am 50), but we have been Best Friends always and he is my lil bro. Hindsight is 20/20. He spent 18 months in state prison. He was released on Mandatory Release last Dec. He has been locked up twice since then. His P.O. makes up violations to send him back. He has followed all the rules since being out. Finished all his programs etc. P.O. has a hard time believing anyone convicted on Sex Charges can be a good person.The latest violation was brought a month after a court hearing which my 17 year old daughter went with me and my husband but the P.O. has said my brother brought her. He has been in jail for 3 weeks. He was arrested on my Birthday. Best thing was we spent the day together( sibling day) first one in 3 years not spent at prison!!!!! I have learned in the past 3 years how very cruel and unjust our legal justice system is. I have gone for the past 2 years to testify before our State Legislators on the UNCONSTITUTIONAL LAWS. I was a pain in the butt at the prison also. I let them know all the time if they did not treat him right. They need to know when they have family who are paying attention. I am in the middle of dealing with P/P right now. I wrote an email Thanksgiving Day to the man in charge. He answered me that day. I have talked to an investigator already and should be hearing back any day. If not I will stay on their butt!!! STAY STRONG KEEP THE FAITH PRAY OFTEN........ We live in Maryland and I belong to a state group FAIR ( Families Advocating Intelligent Registries) also 2 National Groups W.A.R. ( Women Against Registries) RSOL. I wish you all the best and just keep posting and talking. One last thing EDUCATE as many as you can on how EASY it is to be on that LIST. People can not believe what families go through.

Our son was offered a plea, but refused. We would have served just 6 months in jail back in 2004. Instead, he fought the charges for two years.
We, like most families, had no idea about the laws or court systems.He was recently divorced from his high school sweatheart, and was enduring a custody battle for his young son. His wife had ran off leaving him with his son, a year later, she wanted her son back.
Our son had met a young women in 2003 who said she was 19. They never had sex, and he soon found out that she had lied about her age. He refused her calls, even changed his number. That's when his trouble started. She was upset with him because he had refused to see her. After several DA's and after the judge removed our paid attorney, for deserting a client, we were forced to hire another attorney, and then were forced to trial because the girl was turning 18. Our son was convicted, he lost everything too. He served 3 year 4 months in prison, three years, four months on GPS. Six years of harrassments. It hasn't been easy. But, we are fighting in California. Through the RSOL Organization we are now networking to be awareness to the public. Attending City council meetings, meeting with legislators etc. There is now a small light shining. We all need to keep connecting, working, educating, speaking up, showing up and standing up for what is just and right.

She too was found to be a virgin, and her stories changed constantly. It went to trial, got a hung jury, the DA was quite willing to twist the truth, and after her "loss' she vowed to have all out evidence thrown out next time. hubby was tired and took a plea. Thankfully, he was offered 3 months in jail and 3 years probation and 10 years on the registry...still too much considering he's innocent.
This all started back on May 28th 2008.
He's now of probation, but we're still dealing with all the ramifications
