Trust me, these CP charges are enough; in fact, they are plenty.
His attorney knows that him being totally acquitted and coming out of this without a mar on his record is an impossible situation. Hell, they have the CP evidence right there. How can he possibly expect to not be convicted at trial?
Sometimes we have to cut our losses and take the best deal offered. This is not about "giving up" but it is about being smart enough to know when they have all the "goods" on you.
He can never give up; unfortunately, he cannot prevent a conviction, but he can win a battle here by getting a decent plea bargain.

Their son, a high school teacher and a community leader, was caught with several images of CP on his hard drive. The state decided to prosecute.
He was offered a plea for four years in prison, but they decided they could do better by foregoing the plea bargain and allowing the judge to sentence him. He had a respected attorney who felt that he knew the judge well enough to know he would give him a light sentence---or probation.
The judge sentenced him to 13 years prison time and he was a first time offender. The young man had a meltdown right there in the courtroom and went hysterical, as he was not expecting a sentence that harsh.
I think that if they definitely have the evidence, a plea bargain is much safer.

If your attorney is not an expert in cybercrime you might want to find one who is. There is a big difference. If we kept our first one my son would probably still be in prison.
From what I read, it just doesn't sound like the one you have knows what he's doing. There are a lot of lawyers who will take any case for the money. even if they don't know what they're doing.
I doubt getting a deposition from someone at church will make any difference.
They will see that your dad did a search for this woman and it led your dad to it. It doesn't matter why. The forensics don't lie and they will have those forensics. Right there is guilt. There's no telling a nice story to get out of it.
I don't know about other states, but in Floriduh if you have cp, even if you didn't know about it, just being on your computer is illegal. If you know about it and don't report it to the cops it's also illegal.
Why it's on there is not going to help.
I wish I had this much knowledge when my son was first confronted with this stuff. Not knowing is worse as it can make things worse for you in the end.
