Which brings me to my second thought, it shouldn't be public, but LE only. And, there needs to be means in all 50 states to petition for removal. It should be a straightforward, affordable process.
Oh, and residency and access restrictions should be outlawed. They serve no actual purpose.
Well, there are some people that should never be out of prison, some people that should never be able to have children, some people that should have never been on the registry in the first place, some people that should never....., some people that should never.....
We could go on and on forever.
Just because some people are dangerous has no bearing on whether there should be a registry or not.
There are dangerous people who drive while drinking, there are people who commit domestic violence on their partner, there are people into gang activity, and there are people who sell drugs. None of these people have a "list" they need to be on, so why should we compromise and say the sex offenders need to be placed on a "list?"
Why should we compromise and allow us to be different???
There registry should not be public, the registry should not be retroactive, and the registry should not be LE only. Why? There should not be a registry in the first place. It is just wrong in a democratic society to place people WHO HAVE FINISHED THEIR SENTENCE mandated by a plea bargain or a jury decision to be place on any kind of list and be forced to register. PERIOD.
What makes a sex offender any different than a repeat DUI offender or a drug dealer? Nobody else is on a "list" so if anyone can give me a valid reason that sex offenders should be on one, I would like to hear it.

Find and dandy, BUT, if it is TRULY only a civil regulatory procedure to protect the public, then why is the punishment for not complying written in the criminal code of most states?
If this is only a civil measure, why is not complying a felony punishment, often sending people back to prison?
If you are caught speeding, you don't go to prison. If you are caught with no drivers license, they don't send you to prison. I can think of no other "civil" law, which, when broken leads to imprisonment and another felony conviction.
How can non-compliance of a "civil" law cause a felony conviction?
I have asked several lawyers that question and they have no answers. Even my former defense lawyer, a former federal prosecutor, had no real answer when I posed that question to him.

as for the registry itself/? no i don't believe in it at all. if and i do mean if, a registry has to exist for some reason it should only be seen/available to LE. it should never, ever have been put online for public view, speculation and use. with the registry being online it has caused more harm and endangered more lives that it has ever helped.
and no it should not be applied retroactively. why in the hell anyone who has served their time and jumped thru all the hoops over the years and has not even once, since finishing his or her obligation and punishment or caused even a blip on the LE radar? someone who is now a mom or dad, a good average citizen who's trying to live quietly? why should they be put on a registry is beyond me.
