The legislative branch and the judicial branch of our government are two separate entities---the executive branch is the third--- and they cannot infringe upon each other. The legislative branch makes laws and the judicial branch interprets those laws.
There has to be a separation of powers here.
As a result, I don't see how a judge can tell a defendant that he only has to be on the registry for 10 years if the state statutes clearly spell out a lifetime registration in that particular circumstance. Judges don't amend laws to their liking. They can declare them unconstitutional, but judges cannot legislate from the bench.
If a state statute declares that all registrants within that state remain on the registry for life a judge cannot rule otherwise, as the registration scheme has been set by statute which is the role of the legislative branch.
I think Wanderlustwriter guy's situation has to do with the fact that he was able to get a judicial diversion.
