I took Josh's comments of not having to register since 2008 as falling under MI's law that allows people to petition off. It's in the same link above - the petition process.
If he was 100% then they can't charge him - like Rew said.
But I thought his record was just expunged this year.
So in 2008 he could have filed papers with the court and jumped through the hoops needed (the hoops and success rate vary by state) and perhaps won the right to be off early.
But because he didn't file the legal papers (which he didn't know about) then he was still required to register up until either his birthday this year (March?) or until he filed papers - I'm unclear if his obligations ended automatically in March but they just let him stay on the list or if to be removed he had to file something.
Either way March or October I suspect he had a FB account prior.
Honestly, I'd attack the 'willfully' part. Josh was in no way trying to avoid his obligation. He thought he was doing everything correctly. The laws are so confusing and always changing I cannot believe a DA would pursue this case or a judge convict if a decent lawyer was involved.
Elections will be over soon and honestly this seems a waste of tax payer money.
Of course 'they' would see it as a win since it would probably stick him back on the list. I'm a little unclear.

Sorry, but that does not compute! My two sons, who are still in prison, will have to register for the rest of their natural lives.
If I were your friend or family member and you told me you were considering suicide, I would immediately call a suicide hotline. One should never dismiss the seriousness of a suicide threat and I take you VERY seriously. I can't call a hotline, because I have no idea who you are. But, please know there are people around you who do care and would be very hurt, if you did end it all.
You can call a hotline yourself, too. For the sake of all your friends and loved ones, call!
Josh have you heard anything else about this crap?
I think about suicide alot because of being on the registry because of the restrictions because of doing anything that happens in my life may be construted as a violation. I have tried a few times but was unsuccessful. Sometimes I think it would be better to end it all vs dealing with this hell that is imposed on us registered citizens.
I already have a judges signature on an order of removal so from everything that I have read I am off. Only time will tell.
Just hang in there, my good friend. I am pretty sure no DA would even touch this.
Just think, they have done just about everything they could do to you and you are still standing. After this, I am pretty sure they will leave you alone.
