If you view child porn, but do not actually download the image or videos, it will still appear in the cache or as temporary internet files aka temp files.
If you actually download the file, or course, it is on your hard drive and you will be charged with possession.
A recent New York State decision stated that just viewing child porn, ie images found in the cache (but still on the hard drive) is not enough for charges of possession. You can bet the legislators in New York will fix that next legislative session.
I think New York is the only state which has this distinction. In the rest of the states, if they find a child porn image in your cache system on your hard drive, they will charge you with possession. Many times even if they cannot find hard evidence of child porn on the computer, but they can prove you accessed it through your IP address, they will charge you with receipt, but not possession.

We can watch Charles Bronson mow down hundreds of people in his "Death Wish" films or the blood and gore from some of the horror thrillers, but have a 15 second nipple slip as Janet Jackson did in one of the Super Bowl halftime shows and this county goes nuts. That is so damn stupid and silly.

The difference is that here in America we associate a woman's naked body or breast with porn. In Europe, they associate a woman's naked body with beauty and art. Big difference. Porn to many in this country is shameful, and that is the reason this country just cannot handle nudity or anything to do with S*E*X. Geez, just the thought of it makes me shudder. ha ha
One reason is that we have far too many religious zealots in this country.
So, any crime that has anything to do with sex in America is over punished.

My bad. I hope you don't think I was saying you would intentionally have linked to an infected file. It was all on my end and the file wasn't the culprit, my ISP was. I'm paranoid too and the reason I thought it was the file was because coincidentally the problems started shortly after downloading it. But apparently the ISP was having some sort of problem so it wasn't even my computer causing the issue. That was really weird, I don't even use my ISP's default DNS servers. I use Level 3 and I have my router configured and hardened against DNS rebinding and poisoning attacks but whatever was going on it would only allow me to connect to google sites and nothing else. I had scanned the file with Avast and various other malware scanners but in all honesty if it was a virus, rootkit etc.. from the government then most American and even a lot of foreign antivirus, firewall, and malware programs are designed with exceptions and backdoors that allow the governments malware to bypass it and not be detected.
