My son accidentally downloaded 3 cp along with 2335 music videos. He had to plead guilty or go to trial. He was only 20 at the time.
It was in Floriduh. They gave him 30 months in Federal prison, 15 years probation and a lifetime on the registry. Wanna trade?
Wow, Sorry to hear that story, that is insane...You're saying only 3 images and he got 30 months, 15 years probation and life time registry. I know that's what you just wrote, but I really can't comprehend it...
Mine was in 2003-2004. I understand some of laws have changed and the sentences are longer.
What year did this happen, is that what the new sentences are..?
Is he still in prison? When he gets out the probation officer will if him a classification. I can't imagine it should be anything other than a tier 1, the lowest classification, but I don't understand the lifetime probation for 3 images. That is crazy..
You should be able to get the classification even before he gets out. I don't understand.

I really wouldn't want to trade for 15 years probation and lifetime registration, that is insane for what happened. I'm just wondering if maybe their is some confusion to the terms.
If he is classified as tier 1, then it would be 15 years of registration, possibly 10 years with a clean record and authorized rehab therapy. Wondering if that is were the 15 years came in.

I did my homework. I moved to PA hoping that they would allow him be released here. There are no residency restrictions and we live in a city where the probation office is so stretched thin that I'm hoping they won't bother him much. After we get his probation cut back and he's off paper he wants to move to another country, so we're saving up for that. He'll probably be tier 1. They're want to do an assessment when he gets here. If they change the tier I'll hire a lawyer.
Whereas the Federal Guidelines place all CP charges in Teir 1 at 15 years, states like Florida and California put everyone on the registry for life regardless of what the Federal guideline state. The Feds say it is a floor and not a ceiling.
Also, many states, PA among them, place all CP charges in Tier 2 at 25 years. If you notice, Tier 1 and Tier 3 can get a reduction. Tier 2 can not.
