I can't live in this ice box they call an apartment anymore. It is absolutely NOT suitable for human habitation during Calgary winters....
The place is not properly insulated (I'd be shocked to find it is insulated at all, actually..)
There are cracks in the walls making it extremely drafty.
The heat is controlled by the people who live above me, and all the vents are near the ceiling rendering them absolutely pointless because heat rises, and because the place is so drafty and poorly insulated, the hot air coming from the vents is cooled down long before enough warm air can accumulate and begin to billow down.
Sooo.. I might be moving in with a friend of mine whose current roommate is moving out Jan 1st. Problem being my lease here is until Feb 1st... I think I might just not pay my rent and say f*ck you guys I'm out! But with my luck this will be the one company in the city that are big enough douchetards to take me to court over it....

Anyone think I can make a good enough case for getting out of the lease early without legal ramifications?
Might also add that there was a leak in my ceiling a few months back that they "fixed"....but wasn't actually fixed... they just replaced the drywall... it is now sagging already.
but you should complain to them, and tell them that they are rediculouse and that you can't live in such a place. if they do take you to court, take pictures of the aparatment, record the temperature during the day and night, et cetera.

I also agree with Morose. Complain, record and take pictures. I wouldn't pay rent either. If they take you to court, you have all the evidence you need. They'll still be the ones spending money. It would just be a matter of if it'll be on lawyers and court fees, or making the repairs they'll have to make anyways.
I literally have a duvet and one small fleece blanket.
I've taped up most of the cracks I could find which helps a litlte but not a lot... Also covered my window with a towel...
I believe that under the Alberta Landlord and Tenant Act the landlord must ensure the apartment is habitable ... I would well imagine this means your having heat!!!

Hmmmm ... call the gov't and ask if you can put your rent into an Escrow Account until the landlord does something about the heat.
Again, your apartment is not habitable as it is.
