Even though you have a legal guardian, you have the right to make ALL health care decisions. You are fully protected in this regard.
Why do you have a legal guardian?
even people with the most severe physical and/or psychiatric disabilities rarely have a court appointed legal guardian. it is highly highly unusual.
your story just doesn't make sense.
For example: 99.9 % of people living with paranoid schizophrenia, including those that refuse medication, live on the streets and are frequently hospitalized or incarcerated do not have a legal guardian.
may i ask what your diagnoses are that require a legal guardian?
i can't imagine a judge would authorize a conservertorship in your case. you clearly have the intellectual capacity.
if your parents are in fact your court appointed legal guardians and you are unhappy with the arrangement you can change who your guardian is at any time. (if you don't know person, the state can appoint someone to serve on your behalf.
As i said earlier, you still have the right to make decisions about your life, including your health.
Still, i find the sitution you describe hard to believe.
A good friend of mine was diagnsed with paranoid schizophrenia a few years ago. He was 19. He actually sexually molested his younger sister, thinking that he was doing a good thing. (He had determined through a dream that she was going to be raped. He thought that if he attacked her and molested her that it would teach her how to fight back so that i the future when this "rape" tried to take place she would know how to fight the person off. It made sense in his mind at the time, as is the way of many schizophrenics who haven't had proper treatment.) They sent him to a mental institution for a year and then his parents had legal guardianship for the next 5 years. During that time their job was to ensure that he was getting proper medical care. The court system checked in every so often. After 5 years his case came up for review and guardianship was removed. He attends counseling, is on probation, and takes medication.
Through my experience with his situation in addition to my experience as a social worker what Tabby is describing is far out at best and medical neglect at worst. Guardians can control money (to an EXTENT) but they cannot prevent their wards from getting medical care. What they CAN do is question a medical procedure. If, for instance, the doctor wanted her to get an endoscopy and her mom didn't think it was a good idea then she might not sign the form. However, all the doctor would have to do is file a report with APS and say that the procedure is medically necessary and APS would override the mother.
Obviously, there is a problem here. It may or may not be physical. I'm not sure where the blame really lies, but she is not getting the help she needs-whatever that help might be.

I don't have a clue whats going on with your mother! What she is doing by denying you care; is a form of abuse! ( IMO-- it does) She has no right to do this. You are an adult and can take yourself there no matter what- she cannot stop you. If she tried to stop you from calling for medical help ( she doesn't need to know who you are calling either) then she is holding you hostage- and you need help anyway because there is something terribly wrong with her!
I sound a little dramatic perhaps... but I feel bad for you and there has to be a solution to this!
Go out and get help for yourself... if she "won't let you" then she needs to have her "guardianship" TAKEN AWAY!
