How many of you have received disability with just CFS? I have fibro as well but that is manageable. I have been a stay at home mom for 9 years and I just don't know how I can return to work. The CFS has gotten worse in the last couple of years and I can barely keep up with the house and the kids. But I doubt I would qualify for disability. I don't have insurance right now but will be getting it in January so I am going in for a check up and I will talk to my doctor about it. I just wanted everyone's opinion.
The first thing Binder and Binder will do is determine if you are likely to get anything. If you won't get anything they won't take your case, but they will tell you why. If you won't qualify they may help you get SSI.
Are you married? If so you have a great chance. If not, probably not.
There is something called last insurable date. I worked long enough to qualify for disability. Then I became a stay at home mom (sahm) for 5 years. I wasn't married. Then I went back to work. I got cfs and forced myself to work as long as I could. That was 2 3/4 years work after being a sahm. My last insurable date was 2 or 3 years after I became a sahm.
Last insurable date means the last date I was covered by disability insurance. As in you work until you qualify for disability through soc security and that is considered disability insurance. Because i wasn't working and wasn't married I lost the disability insurance. There is no notice of this.
I did not qualify because I got cfs when I no longer qualified. Also when it became bad enough I couldn't keep working I still didn't qualify.
To make it worse I was informed that if I ever went back to work I would not qualify for disability because that would prove that I was able to work.
For me there was no way to win.
SSI is available if you are low enough income (they look at total household income) and you are disabled. Rules are different if you are older.
Binder and Binder told me I would probably qualify for SSI, but I would not get enough $ to make it worth it for them to be involved.
Don't worry about proving you are disabled. Call Binder and Binder first. They can walk you through all the steps, including how to go about proving disability. If you need it they can come to your home and help you fill out paperwork. That is what I was told.
I agree, go with a lawyer from the start.....
