MDH: that is bs! if you didnt take your children to the dentist he could charge you with neglect, this makes me mad for you. i think i would find someone that would listen to me about it. there has to be someone.

have you told this to your lawyer? i mean seriously would a judge let another parent be taht petty? our parenting plan says she is suppose to be involved in all MAJOR medical and school decisions, the day to day stuff is not major. maybe your lawyer can send him a letter explaining that to him. oh, and do you have anything you can hold over him to back him down? i know it sounds bad but hey, whatever works!

Yes. I have told my lawyer. She said legally there's nothing I can do. We have to work it out. When the parenting plan was changed by the judge in August, it was ordered for both of us to attend communication therapy. I went ahead and scheduled this because my attorney said if he fails to attend, then I can file an "contempt of court" against him. The court ordered therapist wants to give him another chance and is personally writing the letter requesting he contact her. She said she would give him two weeks and if he failed to do so, she would be writing a letter to the judge communicating he is refusing to comply. Maybe this will be my break but the therapist said that the therapy issue would be the only thing that would be addressed unless I was lucky.

I'm contemplating on whether or not to seek another opinion regarding "there's nothing I can do."

Also, I don't know the process of filing a "contempt of court" and who knows how much money that will cost. I just don't have it.

If you have a valid agreement that the court recognizes, have you tried taking him for contempt of court if he fails to follow the agreement?

i am still confused, does your court ordered parenting plan say "all major medical issues" key word MAJOR, if that is what it says then i would would suggest telling him he needs to re-read the order and he had x amount of days to contact everyone he has told that bs to and get things straightened out or i would be taking him to court for contempt of court. ours says MAJOR, meaning exactly that, the minor/day to day stuff she has no say in, in fact we give her no say in anything, she doesnt deserve it. i wish you luck, i hate that there is no judge that will go ahead and make him understand that he is wrong for acting like that, does he understand all he is doing is hurting his child?

No. the plan does not indicate major. I'm currently waiting now because one of the things I was able to get the judge to approve was communication therapy. Therapy he so far has refused to attend. The therapist is supposed to be contacting him directly. If he fails to respond to her requests, then she says she will write a letter to the judge letting the judge know he is non-compliant, which would also make him in contempt of court.

Does anyone know the contempt of court process in TN?
