I don't see why you should be responsible for his debt. It's his education and shouldn't be your responsibility. Don't let him bully you into this. I'm going back to school myself and will transfert to med school and there's no way in hell I would ever ask my husband to be financialy responsible for this. Fight if you need to. I know how difficult it is to be married to a med student. You probably sacrificed so much while he never had time for you and you still stood by him, supporting his dream. Keep your head high.

Student loans? I do believe that the debt is in his name - not yours. Therefore you are not responsible for it all all. You aren't the one with the degree, education and profession. He is. It's his debt. He can consolidate any loans into 1 smaller monthly payment for a longer term. DON'T feel soory for him about this, he's the one who'll be reaping the rewards of his career. Don't give in on this!

I do hope you have a lawyer. If not you can get a free consult with one or more, and make sure to bring this matter up. You'll have enough on your hands trying to take care of your kids and yourself. Please don't be offended by this, but it sounds like he still has you wrapped around his finger a little bit. Protect yourself, don't fall for manipulation.

Even a mediator will tell you what you should or shouldn't be responsible for. My therapist is also a mediator. She told me what I should get. STBX made me a ridulous offer and I counted with what she told me is fair in our county. We shall see.

thanks, it just didnt seem like my lawyer had much of an argument but its true i didnt get a chance to benefit from his education and becuase of his degree we dont have much to split more debt then anything. thanks

Educational loans are personal, not marital property. When one spouse dies before paying off his college/graduate school debt, the other spouse will not be required to pay the balance. The amount that remains unpaid by the dead spouse remains unpaid forever. I don't even think it comes out of the deceased person's estate (although I could be wrong about that).

The only reason why you would be liable for his school loans is if you guys consolidated his loans under both of your names at some point (maybe for a lower interest rate). If so, then I'm afraid you're as obligated to pay it back as he is.

Whatever the case, if he's trying to get you to pay for half of his med school loans, is he paying you half of the income he enjoys as a graduate of med school?

thanks frank. my lawyer seemed to not have an arguement. i actually listened at the door with, his lawyer and the mediator discussing this and i heard her say "morally". well, when is law about morals? its all so frightening. i just want my new life debt free with the alimony and child support already agreed on last mediation. will this ever end?

Thanks for this post...I just realised my X paid off her entire student loan while we were married and I still have a student loan as i was a stay at home dad.

I actually am trying to go to med school eventually. You can tell him, he can get off his a$$ and go work for National Public Health. They are looking for doctors, especially internal med, ob/gyn or pediatrics.
They pay back $22,000 per year of work for 4 years, in other words $88,000, if you work for a underserved area. They pay regular physician's salary.
I think the suggestion of that may scare the crap out of him, if he is one of those yuppy types as this usually involves working way out in a rural area or the inner city.
Also, I am sure the military would be willing to work with him.
Just I thought.

Physicians are an interesting group of people. I too spent so many years with my stbx going to school and helping support him. Our loans are finally paid back, but I have no way to equal the kind of money that he makes as a physician. I thought that we had made a deal that I stay home and take care of the children and he attends school and then supports his family. Well suprise, he changed the rules of the game.

If your lawyer is mentioning "morally" right or wrong don't get stopped by that. If the loans are in HIS name. which I'm 99% sure they are unless consolidated previously like FrankLawyer said, they are not your responsibility at all. Zip, nada. zero. Please protect yourself on this.
