Hey I have some legal questions about Divorce, if anyone can help:
In NY you must have grounds for divorce. My husband is trying to claim "cruel and inhumane treatment"....Is this hard to prove (I believe the evidence he is going to try and use is voicemails I left on his cell phone when he had driven me to the point of a complete emotional breakdown....the voicemails were probably highly emotional...possibly yelling, but more than likely alot of sobbing....Is this cruel and inhumane treatment? If not, what is)?
If you were legally separated for a year can you still contest the divorce (We never physically separtated)?
Since we were never physically separated, I would like to see him at least have to wait the required year before being able to divorce me. Is this possible?

Is anyone here allergic to Sulfa that is currently taking Diamox? I have been diagnosed with IH now for almost 2 years. I am allergic to Sulfa drugs meaning that my throat will swell up so my Neurologist put me on Topamax. I was suffering from major loud whoosing noises and the topamax helped that but everyday I still hear those mainly between 6 - 12 pm. I am at my wits end and have not went...
NY law states nowhere that you have to have two different addreses prior to the one year waiting period.
Yes, in NY you must have grounds. Cruelty and inhumane treatment according to NY law is actually the "harshest" ground to file on..even superceeds adultery. Go figure...
it is my understanding that once the year of LEGAL separation occurs then it automatically kicks into divorce proceedings. I would think you would still be able to contest though..
the crual and inhumane treatment is usually emotional and mental abuse.
