if the debt was incurred for marital purposes, it doesnt matter who's name is on the card. its marital debt. it is split 50/50 generally.

I agree with contacting a lawyer or even asking the credit card company because it seems like every situation is different.

I am in a no-fault state. Half of his credit card debt should also be mine even though my name is not on them and I didn't even know about them until recently. However, according to my newly acquired lawyer, since the majority of it is gambling debt i might be able to get off the hook for it. I am also paying all of the mortgage debt and that is way more than the credit card debt. I have also been told that the judges often see how things are and can award differently if they so choose. So, here's keeping my fingers crossed.
It is one of the things that really bugs me. I didn't do this or create this awful hell I am in (he has another woman and isn't interested in trying to make a go of our 34 year marriage) but I am the one who stands to lose just about everything.

Christye, no you don't call the credit card company. All they care about it getting paid and they don't care who pays it.

An "authorized user" is someone authorized to rack up debt on the card! That's marital debt and the courts now make sure the debt is split as evenly as the assets.

Ok here is how it works here, if you want her to pay half the debt on the card it has to be part of the divorce. Now she can say to the bank or who ever issued the check that her name is not on the account and she is not paying. So as far as they are concerned they are going to come after you. You are the only one that can go after her for half the debt on the card. It may not work this way in you state. I got lucky, mine was in so much debt that she filed on all of it so I did not have to deal with that and my credit is good.

It's not up to her. If the debt was incurred while you were married, she is 50% liable. Too bad so sad. She is in La-La land.
You should have your lawyer put the proceeds of the house in trust until the divorce is final. They will take the money out of the proceeds and pay off the credit cards.
Let he think what she wants, that isn't how it works. BUT, be sure you get the money from the house put into your attorney's trust.

Check with your attorney. In my state each party is supposed to be equally responsible for any debt incurred during the marriage and up until the filing for divorce. However, in some instances such as my own--I got stuck paying off just about everything because I am responsible and make more money that the loser ex. Talk to your attorney for the law in your state.

I believe you courier and no doubt that most of them are like that. I must have talked to very understanding credit card companies because they all told me that I was not responsible for paying the debt being an authorized user. BUT, they told me that it wouldn't come off my credit until he paid the debt (he wasn't paying the bills and he went over the limit). Turned out that all I had to do was contact equifax, transunion, and the other one and they took it right off.

Anyways, it's all in material because I forgot to add that it was in the divorce papers in his own writing that he was responsible for the credit card debt. So..yeah..make sure RMAN that you talk to that lawyer and get things in the decree.
