If I move Rogers takalone racks business equipment is still with me.
I had a buyer who would purchased the old equipment for $5,000, previous owner said good price since it was just ahobby business.
One of the sons said he wanted it for that - $2,500 to me but than wanted this piece of equipment (was not a part of the business: air compressor, some other tools - wanted me to give him records of profit/loss/ customer list for last 11 yrs) Roger did not keep those type records - computer geek friend got what he made per yr but no much else, said most had been deleted from older computer - (we could not hack into anymore) so i said ok $3,500 for compressor and small amt of steel left with equipment. Hes shut up now. SO when I move do I take it with me to another state. I do not want or can not afford another $5,000 attorney bill. Any good ideas. My Mom said its in your possession just load it up take it with you, store it forever. Some pretty heavy equipment to take tho'
My daughter has been handled it with them the son clammed up though

Pretty sure the equipment is yours...to keep or sell as you wish. You do not have to give it away for a price that does not suit you even when it comes to family. When you get a computer up...put it on Craigslist and see what happens.

Be aware that commercial movers charge by weight. Me, I'd take the $5000 that was offered. It's YOURS. You can do with it as you want.

I am sure you have things that mean more to you that was your husbands, than this eq. Does his son really want it because it was his, or because it is worth something? I would not move it, but unless you really need the $ , I would make sure family is OK with this - you cant get back what is gone. Good luck and let us know what happens. G-

If you got everything in the will, then it is yours. If there is no title or deed to the equipment, then it is yours. You can sell it if you need the money, but you should sell it for a good price. I don't know that I would want to carry all that to another state, but that is totally up to you. If it means something special to you, then take it with you. If you can live without it, then sell it.

I would not give out the customer lists, that seems like a confidentiality issue to me. I would not want someone giving out my information without asking me first.

There comes a time we need to worry about ourselves. Why don't you get what you can for the things, you may need it. Don't allow the son to complicate things, you have enough on your mind. Do whatever is best for you.

Was the equipment covered by the settlement agreement your attorney worked out with them? I don't understand why there is an issue with this. If it's yours and he has balked at the price, and especially if you can get a better price, sell it for the better price and be done with it. You've given him an opportunity to buy it and for a lesser price and he has not shown any further interest. Sounds like he wants a ready-made business that he doesn't have to invest a lot of money or effort into - that's why he wants the customer lists. It could be that he's seeing that he would actually have to do some work to make it profitable and now he's backing off.

You've already been through the wringer with the sons. If you're still not comfortable with it, send him a letter and give him a deadline saying something like 'if I don't hear from you within 10 days then I will know that you are no longer interested in purchasing the equipment and I will make other arrangements.' Send it by certified mail with a return receipt if you're really nervous about it. That way, if you think he will try to come back at you then you already have the evidence ready to show you tried to give him every opportunity to purchase the equipment for less than market value and he didn't do anything. You have proof that you have been more than reasonable.
