I'm not surprised that Walmart made sure they included your "behavior" as a reason to fire you, tabby2010. They're a sneaky employer, so they knew solely citing poor work performance wouldn't make you ineligible for UI benefits. My question with the "behavior" citing is, was your former Walmart manager specific about what the "behavior" issue was? Along those lines, I guess my next question is, if they were specific, are their charges true, or do you feel they were just trumped up reasons to justify terminating you?

Working for employers without a union contract can be tricky. I know the country has been on a "down with unions" campaign for awhile now, but, as far as I'm concerned, when you work without the protection of a union contract, employers can do whatever the hell it is they want to do, particularly if you work in an employment "at will" state, as Kentucky is. (I live in California, which is also an employment "at will" state.) That's why there's such a campaign in this country to get rid of unions in this country. Without a union, the employer has a good deal of the power.

If Walmart specifically cited what the "behavior" issues were and you agree that you conducted yourself that way, that's one thing. But, even then, I would question what kind of behavior was it? It has to be serious - like stealing from the company or attacking a co-worker. If you disagree with their behavior accusations, I would fight that with the EDD, because Walmart included the behavior citing with the express intent to make you ineligible for unemployment benefits. Just citing poor performance would not have made you uneligible for unemployment benefits.

That said - with the exception of one, crappy 5 week temp assignment from hell, I've been unemployed since October of 2009. I've literally sent out hundreds and hundreds of resumes, taken countless employment written tests and assessments (scoring very well on them) and had several interviews during the last two years - but, no job. Just last Monday, I had the BEST interview I had ever had - ever. I had been contacted by the company's HR department for the position. At the end of the interview, the hiring manager (who would have also been my direct manager if I got the position) said she wanted me to meet with the VP of sales, who was out of the office that day. I thought I would hear from the woman I interviewed with later in the week about scheduling a meeting with the VP. But, even after leaving her a voicemail last Thursday, I've never heard from her again. And, I left that interview feeling so positive and encouraged.

I SO understand how you feel - sometimes I wonder if I will ever get another job. I look at people who have jobs and they literally seem like they exist in a parallel universe or something. I keep trying, but, I've literally begun to wonder what is going to become of me. At least you have your age on your side though, which is a plus. I know younger people are also having a difficult time finding work, but, age discrimination is rampant with over 40 job seekers. And, if you're over 50, it's even worse.

All I can tell you is try to stay as positive and as hopeful as you can. And, just keep applying for positions. There are so many people out of work, you're always up against so many other candidates when you apply. But, I would just keep trying, because giving up isn't much of an attractive option.

Thanks Janice I am not giving up I will get another job one of these days . when I work at walmart I was an overnight stocker. They put me in areas of the store where it was hard for me. The night I got fired they put me in furniture you put an 85 pound person in that department by themselves and when I ask my manager can you please send someone over to me help me they said no you can do it.

my sister had a job interview i think a month ago for something i cant remember. everybody in there (the job seekers) had to take an assessment on math well my sister passed everybody else failed and got an interview probably hired. the manager told my sister we will keep ur application for 90 days she said what kind of mess is that? u would rather hire ppl who couldnt pass the math assessment instead of someone who passed it? why even take a test?!?! the manager was shocked didnt know what to say.

my bf and i are having a very hard time landing a job anywhere. AZ hasnt produced any jobs at all cuz mccain doesnt want any here. even the low wage jobs wont hire us and he has been out of work for now 2 yrs. he has a job interview in 2 yrs (he had an interview last yr wit me at the post office) with macys this thurs i hope he has a better chance of getting it than me.

im out of options/ideas dont know what else to do nobody cant tell me anything different to impress any manager above and beyond.

all i can tell u is to hold tight and keep looking. i was unemployed for 16 months and just found part time work. your job is out there. keep praying and dont give up

I am still applying and looking. I have a job right now its helping my parents care for my grandma but the problem is that I don't get paid for it

The company I worked for tried to pull that during a hearing on appeal..the judge requested documentation which they didn't have and couldn't provide based on given testimony,,,,they lost ...end of story
