Has anyone dealt with OW asking H to sign over their rights?
Saturday was my baby shower (only 5 weeks to go!). In the middle of the party H disappeared for about 20 mins in the bathroom. I figured he wasn't feel good (he went out the night before and wasn't feeling good that morning). But then he came back out and comes over to wisper to me OW just called and she wants him to sign over his rights and she'll take him off child support. We talked later that night about what she said.
She's pregnant by some guy she just met and the guy is playing daddy to OC. My H had called her a few months ago when he found out she was pregnant again and asked her what her plans for the future was and that if her boyfriend wanted to adopt OC he'd gladly sign over his rights, but if she wanted to continue getting CS then he'd exercise his rights to visitation. She said that she needed to think about it and would get back to him before December when we're both due. I was shocked that she actually called him (let alone on my baby shower...for which she congratulated him lol). She only asked that they could start the process in January after she has her baby (either she needs the money to save up until then, or she doesn't want to go to court visibly pregnant again by someone else).
This is good news! I'm physced actually! Once it's done no more CS and we can really put this behind us! BUT as I got to thinking I wondered some more things. If her boyfriend doesn't adopt OC (I believe they'll need to be married first right?) then even if H signs over his rights, will she be able to come back later and try to get CS from him again if this guy leaves her one day?

I am so happy for y'all! I wish our OW would have let my husband sign our rights over! She would never agree (we tried) because we have money and she is a deadbeat living off the system. In our state, once the rights are signed over that's it. She can never go back and it can never come back on you. You don't have to married in KY either to have this done. Prayers for it all going well for you guys and congrats on the new bundle of joy!

I am so happy for you! In our state, once the rights are signed over, there's no turning back. However, rights cannot be signed over unless someone else adopts the child, thereby transferring responsibility so the child doesn't end up with less of a support system and increasing the chance the state will have to step in. I had a friend who did this.
