hi njenlyn71, I am so sorry for what you have been through. I am not a lawyer with a license in either state you reference, so I can't give you legal advice, but I am a lawyer so I thought I would comment. From what you have written, I wonder if the lawyer you consulted was "confused" because he was amazed at the mistakes of your divorce lawyer. About the file request, a lawyer is permitted to retain his/her notes regardless of your request but is supposed to give you your documents. However, if you still owe the lawyer money he is probably allowed to keep the file until you pay. Does your ex have any money? Is he the stalker? I am wondering if you could sue him. If he is the stalker, and you sue him, you put yourself in more danger. Have you consulted with a domestic violence specialist about the issues and how to keep your family safe and also hold this guy accountable? Often you can get free consultations. The state where you got your divorce is the governing state - not where you married. So if you divorced in Indiana, keep looking in Indiana. If you divorced in Kentucky, see about a lawyer there. Go to a county that is different from the county where your divorce was filed. This is important .... if the magistrate and your former lawyer made mistakes, then you are going to get them corrected more easily if you get help from a lawyer who does not deal with either regularly. It is just awkward and embarrassing for most lawyers to have to do that .... which is why very few do malpractice work. You don't need a malpractice lawyer necessarily, but you might find some good ideas from a lawyer who specializes in domestic violence. Most shelters have a referral system .... they know who is good and who will look out for victims and families. Not all lawyers think through strategy in the context of what domestic violence is because some just don't have a grasp of how serious the problem is. Plus, with all you have been through, I would not be surprised if it is difficult for a lawyer to hear all you have to say and follow it. . If you have already tried your best option for another lawyer, I would suggest calling the state bar about your first lawyer's refusal to give you a chance to look at your file.

My best advice is to focus on your health and safety. THe legal process may not be that useful to you until you are well. At the least, your ex will have an obligation to support your children until they are 18 and maybe through college. Once you are healthy and safe, maybe you can focus on getting all the child support for your kids....

hope I helped ... you have a lot of issues to untangle. By the way, you might try a post on your medical issues only in another forum to get alternative health suggestions. Good luck with the medical malpractice cases. If you prevail, at least you can get a settlement to help turn things around for you financially. If there is anything you can do to simplify your life and take your stress level down, please do. As a single mom myself, I have a lot of sympathy for you.

Thank you for your replies and empathy . I appreciate any opinions and advice that i can get. Ive exhausted myself looking for help. I seem to keep falling through the cracks in civil court. I am posting further details in order catch more attention and advice. My lawyer was referred by the DV shelter. As soon as the bigamy was brought up, The legal advocate spoke w/ our local prosecutor in Indiana & he said that the crime,bigamy, would have been committed in Kentucky. There after, her & I spoke to the prosecutor in Kentucky. He said he has, in fact, prosecuted bigamy. If it turned into bigamy used to fraud, he would prosecute. I would have to report it to the county police. I was told, by a lawyer that was referred to me online, that"this case might go down in history.". Confusing, to say the least! When i told the same lawyer, I'd mentioned previously in my 1st post, that i was refused to even view my file, he then asked the DV advocate if that were true. I'm glad I have her as a witness. It sparked his interest then & he pulled up the court docket. 13 times cancelled and rescheduled around 1 judge. His lawyer filed for motion to dismiss, same judge. He dropped that the day we signed our decree. I never received a signal court paper about that motion. I went on to tell him that He divorced the 2nd wife a month after our divorce. They had 3 cases open. All with different cause numbers. His lawyer has since closed all 3. No one even filed for divorce in the first marriage. Yes, I'm number 3. My lawyer's paralegal even checked the basement archives and found nothing. Right After our divorce, that paralegal quit That job & my case has not progressed at all. My ex is still in contempt of the entire divorce decree. Except for paying my legal fees, in which my ex agreed to pay by" payroll deduction".? Same time frame as bigamy was brought up ( This info, about my fees, is on a statement that My exes lawyer sent my ex. I have that statement in my possession. :) ) Since the divorce I have recorded our divorce with the clerk 5 months after our divorce, myself? The clerk had our decree and was shocked that it had not been recorded yet. I inquired about the 2nd divorce and was recorded the day of their divorce. 5 days after divorce, I found many of my daughter's and my things in the trash, infested by maggots. I have a police report and it noted that I collected those things, in the rain. He also changed the locks. I took pictures of everything from money, jewelry, clothes, ...and my lawyer filed contempt. According to the docket, there was a cross IC. My lawyer told me about a letter he received about it, But would not show me or tell me why I was in contempt. Nor, did I receive anything from the court about it. Ex lied terribly about having nothing of value in the house, etc. My lawyer didn't bring up police report & I was unable to show pictures on my phone. No printer. He was found not in contempt and the judge gave us specific orders on how to exchange some broken or outdated furniture he had for me and a ladder that belonged to his work, that I had taken. Questionable if that is true, still, because he has never picked it up from my storage in exchange for the things he had for me. He was told to meet my father at the storage and given 10 days to do it. My mother had gall bladder removed the day after court. 3 days later, I received texts telling me to meet him the next day, or he would drop it off in my parents yard, when he picked up my son. He did in fact do that, they even called an officer to be there. According to police report, his GF called police. She helped him unload, while I video taped it. So, she involved herself in contempt. Those things are still sitting in my parents yard, covered with plastic, because of lack of storage there and a truck and help to transfer them. My parents are elderly and not well. We established CS in beginning of case. The order was a fair amount, because I knew his correct income at the time. On the divorce decree, He lied about his income & overnights. his child support went down. His lawyer failed to modify that with the CS division, so He is now 1500 behind on support. 17$ a week since Sept 2012. He pays support but not weekly. He holds out for a few weeks and makes multiple payments at once. I fled the house In April 2011 w/ My kids( a son of ours, my daughter from previous long relationship), because of DV in front of our son. Cps substantiated neglect, but it was never brought up in court. DV was only noted on 1 printout of the docket, that i received, earlier in the divorce. The morning of spousal maintenance court, I was unable to attend, because my car window had been broken overnight. I had to make a police report. I met the qualifications for rehab maintenance. That court date was not postponed, rather, they brought up the bigamy and offered a divorce decree which was very unfair. They refused to provide disclosure of assets because we were never legally married. We did have lots of assets( retirement accounts, life insurance, bank accounts, equity on the house, a boat,house fully furnished w/ New and things w/ quality ....) my ex took care of our financial. 3 weeks after the car window, came the stalker. It wasn't my ex. This guy tried to sneak up on me during the day, in the driveway of where I am living. I don't know what would have happened if I hadn't heard gravel and gotten out of my car and approached him before he exited his van. I shocked him & He fled. I saw him once more. My neighbor witnessed him 2 times after I seen him, he was creeping. Last time he was seen was 3 weeks before our divorce. My daughter resembles me a lot, so for her safety, she didn't stay the night with me. We have been separated at night since then. 2 years in March. My ex is now remarried to a girl who he has been with since around the time the bigamy was mentioned. She has always been single with a Very High income, no House payment, and no children. They married in Oct. 2013, and she is expecting in March. She has aided in the theft and destruction of our things, has prevented us from following parent guidelines, and was the person texting me, rather than him. Usually condemning texts with name calling. As soon as divorce was final, she moved in, and the child abuse started on my son, from both of them. Making him stay in his room, by himself at home, told to go away, literally pushed away by ex, having sex in the same room 2 times. On a camping trip. My son had no choice, I considered that forced. My ex kicked my son in the stomach, called him terrible names, and they both talked badly about me, lying. My son's therapist called CPS about the sex and his family doctor called about the kicking. He was home with terrible stomach pain for 2 days, when I noticed deep bruises on his stomach. His doctor told me to go to the ER for xrays. The ER Doctor was worried about his pancreas, because of the areas of the bruises. At 8, he had a catscan, doctor ordered. :/ Still no contact to ex from CPS, I had to send him to his dad's. Instructions to give him ibuprofen, the only thing that gave him relief, finally. Ex didn't give him ibuprofen and kicked him again. Finally they made a visit and the abuse stopped immediately. Of course they denied it. Next, they called anonymous on me, and The police came to count my narcotic prescription, since they told them I sold it. No problem was found with the police about that . Shortly after ex started kicking my son in shin. I showed therapist the numerous bruising. He immediately called cps. All reports were unsubstantiated. She has now called therapist to speak with them. I'm very unhappy w her further involvement trying to take my mother roles away. My son said she takes all his dad's attention away. She is always involved when he visits. Needless to say, he doesn't like her. I intend on staying healthy but am taking care of my children's and my parents health first. Not enough hands to help me and no time, to work on myself, yet.

I just keep working diligently and do what i can, while seeking God and gaining wisdom and strength to know what to do next. Ty again! I need all the support that i can get. :)

This guy sounds like a predator...like he has a general narcissistic, predatory personality. Be safe. Take care. Good job organizing your information and taking video of specific events.

Thank you for the pat on the back! it was well needed. My son is our child together. My daughter is from a previous relationship. Since she already went through the breakup of me and her dad, i wanted to keep her from going through it again. However, a typical divorce doesnt take this long, unless its from a narcissist, anti social, psychopath. The fact that they brought out the bigamy and that we both received bad council is what has kept this going on so long. Its terrible that financial abuse, DV, disability, Child abuse was overlooked by the court system. What they do not realize is that when im silent is not because i have given up. Rather, its the calm before the storm, that is gonna hit without warning, while their guard is down. Hide and watch. :) Thanks so much again. Jen-
