It's been a while since I posted.  Some background - late January my 5 year old son disclosed he was being sexually abused by my 11 year old stepson.  There was also an incident that occured with our 6 year old female neighbor, who is best friends with my son.  The state decided not to press charges, but instead enter him into a diversion program.  We spent months trying to find a therapist who could help and finally found a local program for juvenile sex offenders in May.  He has been going to therapy once a week.  About 3 weeks ago, he disclosed a sexual encounter he had in the bathroom at camp with another kid (this time at least his own age).  A police report was filed. The other child would not disclose, so the police closed the case - no victim, no crime in their opinion.  This new incident along with a failed polygraph (polygraphs are a routine part of the therpay program), caused him to no longer be eligible for diversion and everything went back to the state.  He is now facing 2 felony charges.  He was taken into custody Friday evening and had a hearing this morning and was released on house arrest.  I am struggling big time with this.  While I did not want him to remain locked in a jail cell, as I feel that will do more harm than good I am not comfortable with him being released and fear that there will be another victim.  There are a lot of mental health issues going on.  DCF was involved in the latest incident and they, along with his counselor have deemed that he cannot go to school and has to be homeschooled.  He has a 'safety plan' and cannot be around other children.  His mother does not seem to grasp the serious mental issues we are facing here, and I do not trust her upholding the safety plan.  She even asked the judge today if it was okay to take him to the beach on the weekends to get some fresh air.  Why in the world would you want to take a child with clear sexual issues to a provactive environment with people walking around in bathing suits???

I am very disappointed in the state and what I feel is lack of action on their part.  Also, his mother has hired a sleazy attorney.  His website talks all about cases even with rape kits where he got all charges dismissed.  It honestly makes me sick.  My husband is so torn.  At the hearing this morning the judge asked his opinion about his son being released to his mother and there was a lot he wanted to say, but he didn't and he regrets it.  There's an arraignment next week and we've been told the state is taking this seriously and they are going to reccomend that he goes to an inpatient facility for treatment.  I just have a hard time trusting any of it given our experience these past few months.  We still don't know what caused him to do this in the first place.  I am trying to just be patient and hope that the right actions will be taken once a judge has an opportunity to review all informtion in the case.  He had a psychosexual evaluation done and part of the report states that he "presents a higher than average probability of comitting rape and maifests some child molest interests and thinking'. This does not sound like someone who needs to be out and about in society.  The state is going to send him for another eval, but who knows when that will be done. 

I am just trying to take things day by day now.  I wrote a letter to the state attorney and judge this morning, but feel it did no good.
