Who was the abuser? If it was someone who still lives in your house then getting out should be your first priority.
Have you talked to your mom recently about the abuse? You say she witnessed it, but does she admit to that now?

I have reported my abuser, but have learned it happened too long ago and SOL have ran out in that state to prosecute. I encourage you to do so ! My mom knew about my abuse too, but did nothing. In fact, she protected him and still does. Agree with Breakingtheshell, if your abuser is still in the house and you have somewhere to go, I would go. A chat with your mom is important. The abuser was my older brother who no longer lives at home but is still invited over to my parents house from time to time. My mom and I talked about all this with me within the past two weeks. I told her for the first time how violent the abuse and rape was the last two times it happened. She doesn't want my older brother over here any more. I don't know that I'd have her support but her not letting my older brother over is a good start. I want to be hopeful but my mom has let me down before and I'm not sure how this will play out. My mom is acting like we never had the conversation and it sucks feeling like I don't have her support. I don't know that I'll have my dad's support either. He also agrees that my older brother can't come over any more. My dad changed all the locks on the doors so he can't come into the house when we aren't here. It's another small step but there's a big difference between setting boundaries and actively participating to right a wrong. When we were kids my older brother and I always had different rules. He could stay out later, was punished less harshly when he did wrong, and he took advantage of it. If I'm being honest with myself my parents are going to try to talk me out of this. But they've given me no alternative. I feel out of options.

If I had any regrets it would be I never reported my abusers and prosecute them. One being my older brother. I often think at least maybe I could sue him and hurt him where it matters most to him. His wallet.

Losing his wife and kid would be the bonus for me.

Alas, it has been so long and at 45 no court in the world will hear my case.

I would personally go for it if I were you. I would also move and take up the offer to live somewhere else. I would def. keep all lines of communication open with parents. It sounds to me that maybe they just dont know how to deal with it really, why they are not saying much about it. Maybe let them know how your feeling.
Keep sharing, and keep talking to them openly. I could see that it would be hard for them as well. They believe you which is a good start and not allowing your brother to come over anymore is great support.

I think the fat that both your parents have stopped your brother coming round is a really good sign, but whether they are able to go the whole way and support you prosecuting him is another matter. Whether they do or don't, you have to do what is right for you.
How did the talk go with your dad? I guess as your brother can't come round whether or not you stay depends on how your parents react to your taking legal action.
I think you are very very brave and strong to even consider it.
