I know how it is. When one thing goes wrong everything goes wrong. You two need to see a third party maybe consumer credit counseling. If you are making payments on both houses, stop and just make payments on one. You can always let the other house go in to foreclosure. Don't deposit more money in to that bank account. Go talk to a rep at the bank, they may waive some of the fees. A foreclosure on your credit report is not half as bad as a bankruptcy. Do you have family members? Swallow your pride and go to them. Do you belong to a church? You need to find emotional support.

I don't have too much to say due to my age and never actually owning a house but I can say that I know how you feel being at rock bottom with no money and having bills to pay and what not. Although your bills are way out of range compared to mine I feel for you and your husband. I wouldn't want to be in you position and I don't want to be in the one that I'm in now. I wish you luck and hope that you make it through because no one deserves to have money be the reason they live a different life. What state are you in? I am in OHIO and we are in the process of doing the bankruptcy ourselves... do a search online and check for the documents you need. My sister in law did this her self,, and hers is discharged now... check and see what u can do

I agree with Thatgirl3. Banks have a lot of leaway regarding fees and such for overdrafts. Many times they will take away most or all of the fees. I'm sorry for what you are going through. It will be hard, but it's not hopeless.

I can't give advice on what you should do because I'm here because I'm a spend-a-holic and need help myself, but I do understand how you feel and have had a car repoed, filed bankruptcy, and had the bill collectors calling etc. I was fortunate to be still living with parents though.

I just wanted to let you know that when I filed my bankruptcy, it only cost me $300 (state of MD). Is it possible that you could find a lawyer with a lower fee, or like someone mentioned, see if you can file yourself.

As for your house, that's tough! I have an aunt who moved from Ohio and it took more than 6 mos. to sell her house. She had to reduce the price of her house 3 times before it could be sold and ended up owing money to the mortgage co to make up the difference. Question is...if you let the old house go into forclosure, could you still keep your new one? Would it make a difference if you feel you are already in such a bind? I REALLY hope that things turn around for you. Try not to be depressed because it only clouds your ability to figure things out. Don't know if you're a christian or not, but I was always told that GOD will make a way out of no way.

Thanks to everyone for their replies to my post. It's so great to have DS and all the people here. Hubby called a different lawyer who specializes in bankrputcy and offers a free consultation. I think in Fl (where we are) they can't take your home, so we'd just lose the old house and we're ok w/ that, at this point. The bakruptcy lawyer has not called us back yet and the bank has not called us back yet re. waiving those charges, which we hope they will because we're long-long-time customers in good standing. So we have all weekend to stew and worry. I'll try to stay positive. Thanks to all of you for your replies. Hugs to all!

My husband and i are in a similar situation. We bought a house in May and I have a condo from before. We just found out that several units in the same complex are going for 10K less than what i paid for mine. We can't afford to pay it anymore and we have a baby coming in April. I'm really worried about what is going to happen too. I took the first step and called a financial advice place to make an appointment today. I nearly had a panic attack about it. Its hard to have faith that everything is going to be ok, but it will.

I wish i had some good advice to give, but all I can do let you know there are other people in a similar situation.

everybody needs help now and again, do not be afraid to ask your govt. you may qualify. I am having financial troubles my self, but i always try to find a way out, even when there is no hope on the horizon.. Family support is key, without family you have no-one.

I do not know how much equity you have in your 1st house, but you could either rent it or get a home equity loan...I do not remember FL law but if you have it available, I would suggest a libe of credit type loan against the equity. do not take a lump sum loan unless you truely need it all. Once you get your head back above water pay it off asap...It can be a killer but if used correctly, a life saver...

Additionally, talk with the bank that carries the loan on your 1st house...Maybe an interest only loan will lower the payments long enough for you to get it sold...If even at a loss, that monthly payment will be out of your budget...

I know you're not to supposed to tell someone this, but I know exactly how you feel. We are in foreclosure and bankruptcy and all I want to do is cry. But I can't, so it is all bottled up inside. My husband is in denial, I think, which puts me in overdrive mode. I have to take care of the children, so that drives me. I have a good job but tomorrow when I get paid there will be only $20 left in my account for groceries after I make my car payment and pay the utility bill. I used to pray for a miracle, but realized I was praying for the wrong thing. Now I pray for clarity to do what I need to do to make things right again. Try not to be scared. You will be alright.
