Hi guys. My husband and I are in a debt repayment program...almost 3 years in to the 5 year program. I'm thinking of filing for divorce and I don't know if or how this will affect the repayment? We did file separately so that might help. They have post dated checks which combine our payment but those can be replaced.

Any advice?

Maybe consult a tax lawyer or tax preparer.Also, ask a question on
Allexperts.com and they will email you when you get an answer.
I use them among other research.

I agree with Ross - Definitely check with a Tax attorney.

Fortunately, I was in good hands with my divorce attorney overall however come tax season this year (post divorce) I was wishing I had ran a few things by him.

Also, consider getting a review of your divorce agreement prior to finalizing. Good luck! and it sounds as if you are really thinking this out. Good for you :)

If you signed agreements with the debt repayment program, which I suspect both of you did, then you will owe that debt and be required to pay it back. That agreement may have allowed them to have already filed a lien which would hold against your home, cars, etc.

Dig out the paperwork on the debt repayment and read it thoroughly to see what it says.

Take everything, including the debt repayment paperwork to the divorce attorney to find out ultimately where you stand, but I suspect nothing will be changed with the debt repayment plan.

Thanks guys, all great advice. All of our stuff is in storage right now as we are living with my parents. Probably something I should have kept handy though. So many things to think about at a time like this.

Don't have much more to offer, though I will say that it doesn't matter how payments are set up or even what is written in a decree.

After a divorce, people don't care what is written they will go after payment from whoever seems to be paying....
