Does anyone know the answer to this?
I live in California.
My doctor ordered x-rays. I got them done in a hospital facility, not at my doctor's office. I/my insurance paid for them. I later hand-carried the FILMS to the doctor's office. The doc kept them. When I asked to keep it, he wouldn't give them to me.
(This doctor is an asshole--arrogant, rude, dismissive. I want to go to another doctor, thus I want the films.)

My Guess...is that the doctor has the right to have them as part of your medical record and so that he can look back on them as needed.
But for a second opinion, you might be able to either have them or to get copies made.

Get rid of that ass of a doctor but first demand your x-rays. I went in once and made a real scene to get some ultrasounds. There is nothing they like worse than a scene at a doctor's office. Just go in and say "we can do this the easy way or we can do this the hard way but I am not leaving without my x-rays." Or if you don't want the confrontation have another doctor request them for you! Good luck...what an idiot, so sorry. Like you need this kind of aggravation. xo
According to the CA Med Board, the HOSPITAL LAB owns the records. If I want copies made, I have to go to the hospital lab.
BTW, these were FILMS, not disks. (The doc specified films; he didn't want disks because he said they're usually not clear enough.) Many times in the past, the labs would give me the disks which I hand carried to the doctors who looked at them and returned them to me--they didn't even want to keep them. The radiologists' reports were good enough records for them.
I am angry at this a-hole doc because of his hostility and greed! This is for trigger thumbs! I had a trigger finger on each hand last year. Last year, I went to another doc (due to different insurance) and she gave me a cortisone shot in each hand during the same visit and was done.
THIS a-hole doc wants to make a mountain out of a mole hill! He wants to give me 6 shots (3 on each hand). AND he wants me to come for 6 SEPARATE VISITS!! ( So he could charge 6 times!) When I asked why separate them all out, he got defensive! He asked me, "What do you mean by that?" I asked why he can't do 2 shots (one to each hand) at once, he just said, "It isn't safe." I didn't dare ask why because he looked like he was about to bite my head off!
Then he started to cut up my x-ray films! (Trimmed them smaller to fit into my file). When I asked to keep them because I thought they were mine since I paid for them, he said, "Your INSURANCE paid for them." Then I said, "But I paid for my insurance."
Then he handed me a scrap of the film and said, "You want them? You can have these!" The nerve!! Then he said, "I need them for my records, Jesus Christ..." Yep, "Jesus Chris", he said.
That was my 2nd visit. On my first visit earlier in the week, he gave me one cortisone shot. On my 2nd visit (when I brought my x-rays), he seemed so surprised and DISAPPOINTED that that thumb didn't hurt anymore. He started to push and tug at it so hard (asking, does this hurt? Does that hurt?) that i started to withdraw my hand away. That thumb joint moves up and down naturally; NOT SIDEWAYS like he was trying to damage it so that I'd have to come back and fix again!
Anyway, I'm pretty sure my thumbs do not need anymore than 1 shot each. So I won't ever go back to him. Even if I need to see another doc later and need those x-rays, it's still less aggravating to get them from the hospital records or take brand new x-rays again. (My insurance pays for all diagnostics. So if my insurance doesn't want to pay again, they can go after this a-hole doc themselves.) I do not need anymore aggravation since with fibro, I don't have any excess energy to spare! I was only very curious as to what the rules/laws say about ownership of x-rays.

Oh, it's more effective to bad-yelp him than cause a scene in his waiting room since no one else was there. I subsequently checked his yelp reviews--all his bad reviews were for hands! (He's a plastic surgeon who also does hands.)
