I got a "partial judgement" from my SSD hearing. I'll try to make this short: I last worked in May '05, but in a county job, no SS payments. So, the last date I would have been eligible for SSD was 12/31/06. My second application for SSD was 2/07. Also, from 5/05 to sometime in '07 I was unable to get any medical treatment, and even then I couldn't get treatment for fibro. The judge said I was not disabled until '07 and would only award SSI, starting in September '07. My attorney said we can appeal, especially since I left my last job due to the fibro, but that the whole process would start over and I could be denied anything. She tells me that SSI will be beween $600 and $700 a month. I have been living on less than $300, so this is doable, but I'm wondering what you all think.

I not sure but check with your attorney. I don't see how they could stop the SSI once they found in your favor. I would think that you could still appeal the SSD as they are two seperate things.

I just can't imagine having to start over. The wait is incredibly long. I don't know how you've been hanging in there on the pittance you've been receiving.

If it were me I would take the higher amount on SSI because that is some sort of security for now. But that is just me.

I just lost an appeal with my LTD so I'm not feeling very positive this evening.

cheers to you for fighting this fight. It must take so much energy & cause much stress. I wish you luck and hope you get as much as you can. They make it so hard for those who need and deserve, yet you see so many who figure out how to easily work the system. Good luck to you

In reading your post again I may settle for the SSI Because you have no medical records for 05 to 07 so proving your disability would be very hard for SSD. For SSD it is based on your payment into SS and how long you have gone without paying into the system along with supporting medical records and alot of other factors. Do you have any medical records that would support a disability from 05 to 06 it doesn't have to be fibro.

I would double check with your lawyer. I don't have that much experience in this area so I could be wrong

There are programs that supplement SSI and I would check into that along with any state run programs.

Hi sandy I believe if you do not have medical records to support your disability for the dates you are listing and did not pay into SS when working for your county job.. I would probably if it was me go with what your attorney would advise you to do. I could not handle going through this process again ...My disability decision went back farther then what I thought the judge would give but was due to medical records that could support it. I am having problems geting my back pay straightened out where I can understand the changes they made from what was told in the beginning. My decision was back in Jan and took them till Sept or Oct to tell me things are different then was told in the beginning .. Brain fog hope making sense here.
I think it depends on how you feel about waiting again to get things settled and taking a chance of being denied anything. I am not sure how that could even happen really if they already said you were entitled to the SSI. But know all of this can get pretty confusing,
I know with SSI the back pay is back to when applied if is SSD or RSDI goes back one year only from the date applied.
Was wondering did they have a benefit plan for disability through the county job that was paid into ?

Thank you everyone for your comments and support. Maryca, no I don't have medical records for that time since I could not afford a doctor. And, before I left that job, the doctor I had wrote anything I told her just so I could keep the job, so her letters indicate I could work an 8-hour day. She didn't agree, but did that because I wanted to keep working. I was too stubborn to admit that I couldn't. Because of that, Emerald, I didn't even think to check into disability through the county employer because I refused to NOT work. I started waking up when I realized that I couldn't even follow the conversations in job interviews and would spend days in bed just from the stress of those. Maryca, I do get food stamps and have Section 8, so I guess I will have to continue with those. Sorry, quite dizzy this am, so I start rambling...

Anyway, thanks for the input. It's been a long process. I think I will take my ball and go home.
