I feel his pain. I'm one of those, too. I'm still hoping it hat out legislature realise what punishment it is to be on this list. It is an ongoing sentence whether they want to admit it.

My hubby is on, and because his "offense" was prior to December 20, 2012, he's been reset to his original 10 years, and he should be off in 2020 versus lifetime

My son just got paperwork from the police station telling him he had to come in a reregister.. even tho he went in January for his once a year. They're all confused about it. No one understands half
of these new laws.

My son's offense was also before 2012.

Yeah, my hubby got the same thing, he did his last registration on Feb 9Th and his paper said he has to redo it between Feb 22, and May sometime. I think we'll go next week.
After that, he has to it once per year around his birthday unless he has changes to report. And I don't think he has to report as much stuff either.

So, basically (to me) this is the first step of the reset for my husband and hopefully he'll be off in a few years. like he should have been in the first place

If he's not an SVP, committed his crime before 2112, and is off supervision, He will get paperwork saying so. Don't do anything different until then. There is something like 17,000 offenders on this list waiting to come off. They're taking 1,000/month off the registry. Give them time to sort it out. Each case has different parameters involved making it difficult.

A judge told me once "The only thing a dem senator or rep senator agree on is the sex offender registry".

Just a heads up----

In Oklahoma in the Starkey vs Oklahoma Department of Corrections case, the Oklahoma Supreme Court ruled in much the same manner as the Pennsylvania Supreme Court in the Muniz case. It ruled that the application of SORNA to registrants convicted before SORNA was established in the state would be punitive and a violation of the ex post facto clause of the Oklahoma Constitution.

This is how I was removed from the registry in Oklahoma.

The Starkey opinion was in June 2013.

They did not get me removed from the registry almost a year later to the day. I finally received notice from the state in June 2014 that I was removed.

The one year delay was b/c they had to investigate each case before removal, and that took a lot of time. Oklahoma had 7,000 registrants to remove.

Like Pennsylvania, Oklahoma had several thousand registrants to remove from the registry and it took them a year to get to my name.

So, be patient. If your loved one is eligible to be removed in Pennsylvania, it may take a while for them to get to his case and get him removed, but he will be removed at some point.

Until then, unless Pennsylvania tells you differently, just go register at your normal time as you always have. They will come to his name and will remove him if he is eligible. I know it is difficult, but try to be patient.

From what I understand, my son, who is not SVP,.. has 11 years left on the registry... was going to be one of those removed, but I thought from the new law the governor put forth that it will keep him on. That's why the law was passed, wasn't it? To keep everyone on?

If he comes off in a year that would be cool, but from all I've read they didn't want anyone coming off the registry and so passed this law.

it's all so confusing.. and you don't want to not do something for fear of violating.

Governor Tom Wolf on Wednesday signed House Bill 631 into law, now Act 10 of 2018, the primary intent of which is to provide for greater public safety by ensuring convicted sexual offenders remain subject to registration requirements in the wake of recent court decisions impacting Pennsylvania’s implementation of the Sexual Offender Registration and Notification Act.
The legislation, introduced by Rep. Ron Marsico, would ensure that as many as 12,000 sexual offenders remain on Pennsylvania’s registry and subject to the regulations in place at the time of their offense – either a 10-year or lifetime registration.

My son is supposed to be on it for 15 years. I wonder if he's going to be taken off or do 10 years or do 15 years. I wish I had a lawyer who understood this stuff better

We have known each other for a long time. I have always admired you for the manner in which you have fought for your son.

Regarding his registration, if you will give me his date of conviction and his present tier level, I will see what I can do to clarify your son’s status on the registry.

Nobody really knows for sure the state of the registry, as there was the Muniz decision and then the Pennsylvania legislature decided to do a run around and pass more legislation.

But I will do my best to help you with this. If you want me to attempt to decipher the Pennsylvania situation to help your son, just let me know. If so, just give me five or six days to research everything regarding your son, as I am completely covered up at the moment.

If there is anyone here who is also confused about the Muniz ruling in Pennsylvania, get me the proper information and I will see what I can do to clarify matters.

He was convicted Nov 2nd 2011. He's been on 15 year probation for 4 years and 2 months now. Level 1.
I'm really glad we moved out of Floriduh or he'd be on there for life.

I'm assuming at this point they've lowered his 15 years to 10, but it's confusing. I first thought he would get off it this year from the way the laws read but that might have just been wishful thinking.

I really appreciate you helping me out.

He's still depressed and each day he tells me he hates being alive. I wish I could do more for him. I'd take it on me if I could. He's just 28 and hasn't had a girlfriend since he was 19. it's a lonely life for SOs.

Amazing they can change it now since it was put in his sentence orders. I'd check with a lawyer on that

My hubby was sentenced to 10 years on the registry in 2009. In december 2012, he was moved from Level one to tier 3 and made a Lifetime registrant.

I'm confused too but I thought there was a question (prior to the State Supreme Court ruling on Muniz) with Megan's Law as a whole in PA and somehow it created a loophole that could have meant everybody could get off, and that situation was what the Legislators were trying to fix?
