It can very. Hubby's trial was several months, and many inmates said he was railroaded as majority have been waiting for at least a year before they went to trial. But regardless of where you live, it's always better to wait it out. The longer it takes to go to trial, the better it is for the defense.

Statistically yes indeed it is. I think I read somewhere that unless it's a murder trial or some crime along those lines then the chances for a sweet heart deal or dismissal go waaaay up.

I was arrested on April 1, 1991, had my preliminary hearing in August of that year, and my trial was on May 20, 1992. So there was a span of 13 months between the arrest and the trial.

Of course, in the 13 month period, there were a lot of pre-trial conferences and some other minor court events.

As we have discussed, your best defense is waiting her out. They are already weary of all this, so keep the heat on them. Of course, there is a limit to the number of continuances and delays the judge will put up with, but stalling almost always helps the defendant.

Some of these cases such as yours will implode on the DA given enough time.

One thing I have noticed in the past several years is that DAs are more reluctant to drop the charges that they were years ago. Even if the complaining witness or victim no longer wants to participate in the case and does not wish to testify, the DA tries to find a way to entice the defendant to plead or go to trial. They do not like to drop the charges.

I was offered a plea for five years in October of 1991, but I turned it down. Plea offer in October and trial the following May.

It's been 15 months and no plea deal yet. Our first plea deal should be sometime next month which I already know I'm going to deny. We'll see if they counter or want to go to trial after that.

Gosh, has it been that long? It seems like only a few months ago that we started PMing each other to discuss the case.

Without seeing my two evaluations yet, one from my therapist and the sex offender eval which I passed with flying colors the judge and prosecutor already want prison time for me so I'm not so sure on the sweetheart deal here. I think we're going to have to end up pushing it to trial.

Without her testimony and no physical evidence, I would think the DA would have a tough time if he took it to trial. Someone has to tell the court her story and what happened, and if she refuses to do so, that leaves the DA with some tough choices.
