That is if you were put on retroactively like I believe you were Firecracker... but for those that were put on 'legally' according to the laws that they were convicted under they need to take it to court... Federal court if possible so that the constitutionality of it can be challenged. Otherwise we will be hitting our collective heads against a wall that is unforgiving.

I think you maybe right on that one Wisconsinrsol my conviction was in 1995 my probation was over in 97 then i was put on the list had to do that once a year thing the residency restrictions then i started writing letters saying these laws were being applied to me EX POST FACTO then they took me off

But i do have a question if they took me off here in California if i want to another state do you think they would make me registrar in another sate?

My guy was not put on the registry retroactively. Here is the timeline:

1994 "crime"
1995 arrest
1996 plea, received probation
1998 Internet SO registry started and all had to be on the site (he was under supervision so included him)
2002 completely RELEASED from supervision and all restrictions
2007 AWA passed in Florida requiring MORE information from SO's (email address)
2010 arrest for not registering email address
2011 sent to prison for re-registration violation (via a plea he was bullied into with the threat of five years)

AWA specifically states that anyone who was not released of their sanctions by 1997 is subject to the re-registration requirements. That is where the question comes in. Judges have ruled that adding new requirements for SO's who were already released prior to 2007 is non punitive. Even though, they should only require those convicted after the law has been passed to adhere to those new requirements (make sense?)

My guy would NOT have taken a plea in 1996 if he would have known his face would be plastered on the internet in just a few years, and subsequent life would be heck..he would have fought the charge!. How can someone agree to a plea with certain conditions, and then keep getting stuff added on. That is why the ex post facto clause exists...so the government can't punish us forever. Unfortunately in the case of an SO, the constitution does not apply.

Firecracker, More than likely you would have to register or fear a possible felony charge against you. Each state follows it's own rules and you only had CA remove you... Granted it would be harder for them to find you without the registry but have you checked the WatchDog sites that have national information to see if you have been removed from all lists?

I know I had to email them and threaten a lawsuit for them to remove my husband when he was out on appeal.

Family Watchdog I think... just google Sex offender registry and you will get a bunch of national ones.

If you are going to another state you will hvae to check their laws to find out if you need to register if you are visiting... I know that in WA you have to after you have been in the state X amount of days as does MI the last time I checked. It should be listed in their sex offender statutes.

wisconsin, what about the no fly circumstances? Aren't SO's on the no fly list? I would check that out with the US Marshalls as well.

"SO cant fly"...Might be different laws ,for different level of crime and state laws ...for the last 10 years ..(in texas)...I have flew to most states in the USA ,never no problems....pretty much flew every month...Firecracker...I have thought about registries in other states also if I was thinking of moving .....and was off the registry in the state I was in ....I would like to know myself !!! I think that is the A.W.A brain child ,for everyone on a national SO list once a SO always a SO....!...believe me I ve looked at every state for a loophole...!

I did a little research, and I can't find where SO's are on the "no" fly list and recently SCOTUS said that it is unconstitutional to bar interstate commerce to SO's.
Besides, I don't wan't to get felt up by some minimum wage, High school dropout TSA loser.
