1994 "crime"
1995 arrest
1996 plea, received probation
1998 Internet SO registry started and all had to be on the site (he was under supervision so included him)
2002 completely RELEASED from supervision and all restrictions
2007 AWA passed in Florida requiring MORE information from SO's (email address)
2010 arrest for not registering email address
2011 sent to prison for re-registration violation (via a plea he was bullied into with the threat of five years)
AWA specifically states that anyone who was not released of their sanctions by 1997 is subject to the re-registration requirements. That is where the question comes in. Judges have ruled that adding new requirements for SO's who were already released prior to 2007 is non punitive. Even though, they should only require those convicted after the law has been passed to adhere to those new requirements (make sense?)
My guy would NOT have taken a plea in 1996 if he would have known his face would be plastered on the internet in just a few years, and subsequent life would be heck..he would have fought the charge!. How can someone agree to a plea with certain conditions, and then keep getting stuff added on. That is why the ex post facto clause exists...so the government can't punish us forever. Unfortunately in the case of an SO, the constitution does not apply.
I know I had to email them and threaten a lawsuit for them to remove my husband when he was out on appeal.
If you are going to another state you will hvae to check their laws to find out if you need to register if you are visiting... I know that in WA you have to after you have been in the state X amount of days as does MI the last time I checked. It should be listed in their sex offender statutes.
wisconsin, what about the no fly circumstances? Aren't SO's on the no fly list? I would check that out with the US Marshalls as well.
