If he wasn't an ex-Sheriff his motion would have been denied, it's the "Good 'Ol Boy" network.

I posted a while back about a retired Police LT. who was in my "group" who molested his grand daughters 7 y/o friend during a sleepover.
He spent 10 days in jail, Therapy, 1 yr. probation and didn't have to register. The Good 'Ol Boy network again.
Right now he is doing 15 to life in Idaho for the same thing, and just a couple of months ago he was also sentenced to 5 to life here in Utah for the same thing as well.

That's ludicrous. So many people with non-violent or consensual crimes have to register for 25+ years, sometimes life....
Crooked cops. It was a crooked cop who arrested my boyfriend for CSC. Funny, the officer was ex FBI and was caught with child pornography. Guess what happened? Slap on the wrist. They put him on the night shift and took away his gun. He kept going though, until finally they found him divorcing his wife to be with an underage girl. He did some jail time, but he's back on a police force somewhere in MI.
Scary, eh?

This is PRECEDENT... something that can be used against them... and since it got ruled on in the Supreme court there, this can open doors for others with the same charge...

Yeah it sucks but if they start giving passes to their friends in a legal forum that is documented and not behind closed doors they are helping the rest of us too. This is their Karma coming back at them... if they want to be 'nice' to their own people and do it in the public forum then they will be doing it for the rest of us.

I agree wisconsin...lots of open doors for citizens of Washington State with the same conviction...if ANY of the Florida appeals regarding AWA and it's ex post facto violations gets ruled in favor of someone released before it passed, I am going straight to my attorney. Unfortunately as of right now the judges say it is "non-punitive".

All that is needed is ONE judge to say that it is punitive and unconstitutional. Granted it will have to meet muster in the appeals process because you know that the State will appeal if the court rules against them. But that is what fighting for our rights is all about... Start with one win... and build on it.

I wish I had the money to appeal this conviction for the email address. If any case would make sense, I think this one would. After all, his original arrest was before the internet registry even existed. He has committed no other crime since then (1995) and was put in prison under AWA which was passed in 2007 here. My question is...how can they say it is non punitive then throw them in prison for not complying? Obviously it is a "punishmen"t he did not comply with. If I had the money and a good attorney I think my guys case could be the one that makes a judge say HMMMMMMM.....

I already did....she said all Florida judges have ruled it to be non-punitive so not a violation of the constitution...WHATEVER! Like I said....if I had money...a constitutional attorney...and a judge who still believes in the constitution, I would appeal this whole thing! (money, unfortunately, holds me back)

That is why it needs to be taken to the Federal Level when the State judges are too worried about votes to actually rule constitutionally...

like i have said time and time before write letter after letter after letter don't give up someone will hear you! i did and i got taken off this stupid list i don't care what they say it is UNCONSTITUTIONAL and that crap about it being non punitive that is how they were able to circumvent the Constitution it IS punitive otherwise he would not be in prison

I wrote my first letter to Gov Scott and got a form letter return....it addressed any possible gripe with the justice system. It did not apply to what I wrote. Next will be Rubio since he is a tea party member and they are "for the constitution". We shall see how that goes.
