It really depends on if anyone makes a stink about it. I won primary custody of my minor children along time ago when I was a registered citizen and raised my kids. A boy and a girl without incident but I had a sane judge and everyone involved in my custody was sane.

I met with friend of the court and child protective services and had no objections regarding my status as a RSO when I was awarded custody. I sent my kids to private schools and even paid support to my ex even though I had primary custody. Not joint custody.

The environment was much more sane back then compared to now but I have spoken to other RSO's that have had custody. I'm a tier two.

If the charge wasn't against his kid, and you only have biological children with him, then most judges and PO's will allow him to stay with you. If there are children that are not his, then more times than not, he isn't allowed to live in the same house.

Yep it was a CSC/4th degree high misdemeanor. I think a lot of it has to do with what the sex offender therapist writes. I also had to see a special psychiatrist that had to give a report that specialized in sex offenders and had to take a lot of tests. It wasn't cheap at all!

The guy in Oklahoma also had custody of his kids but he got in trouble when the police found a bullet in the back of his pick up truck. The press really tried to create a circus with his case and he had two judges side with him.

Your boyfriends case doesn't sound like the type that would prevent him from being around his own children especially if he gets favorable reports from the states experts.

Yeah , the crimes ( felonies ) that he has been convicted of have to do with a 17 almost 18 year old , that is not his child. But was a minor. So i am really hoping that with him completing treatment and him doing well while incarcerated , will make everything okay.

I am not aware of any law which precludes a RSO from having children and then living with those biological children.

The problem is usually when the children are stepchildren and especially if the child was the victim of his crime.

But no, they cannot prevent him from having children with you and living with those children.

Conditions of parole can often say can't be around minors. Now a days parole can last along time. I know a few guys a prosecutor went to terminate the fathers rights even though his children had nothing to do with his charge. It can be won in court usually but nothing seems absolute in laws regarding sex offenses.

Prosecutors often try to civilly commit some offenders in some of the more extreme cases and states depending on the severity of the crime. In those cases of civil commitment sometimes the termination of parental rights happens.

Sometimes RSO's even win custody and that really was my point. It depends on many things and the fact that the victim was 17 I think makes a difference compared to if the victim was 5 and severely injured. All it takes is one person to petition a court or claim child endangerment and you have to prove you are not a danger anymore. Being on the registry you have already been declared a dangerous person to society as I have.

The difficult to understand part comes in when top experts declare you rehabilitated and a low risk then the state calls you a moderate risk. So much just depends on the people that access you. I'm absolutely positive I could have been declared a tier one or tier three depending on who accessed me.

Although, I will admit. Hes naturally a laid back guy, and is someone that will comply and address what he needs too while incarcerated.

My hub and i went thru the ordeal of a past probation officer tell my hub he couldnt live here with us .it devastated us .but in tgat moment we got the notion in our head to get to court and ask the judge if it was ok .we waited til last case which wasnt long at all .and asked to speak to judge and da was there..the judge asked da if she felt it was ok and any objections .she asked if wss bio child not step child .we told her yes it was our bio child .she saud no objection .and if probation allowed ot it be fine .well then hub went bacj pro office and asked pro and she agreddd it was fine for my hub be ib same home livinh with us .since court said it was ok ....when something serious comes up such as that or anything else ..i would recommend making notion to talk to judge of the case and see what he she says .it took the appearing before judge da and then probation again .
