My son had a bit of a situation when he was in Federal prison. I paid this fee when he first went in and then they told him it wasn't paid.. and they were going to put him in the shu for it and give him points.

I had to mail my son the copy of the receipt so he could show them. But they put up a big stink about it.

You'd think this kind of thing wouldn't be such a big deal, especially when you can't pay it but they really put the scare into my son.

And if you send him any money for commissary or to buy things at the canteen, they will probably take a portion of that until the $100 is paid.

In the state prison system, the state took out a certain percentage, usually 10%, of any money earned for court costs, fines, restitution, etc. I am not sure what percentage the federal system will take, but they will take a portion of it.

So they will take a percentage out of any money sent in by family and any money he earns while working in prison until it is paid in full.

You and your son are fortunate that he was not ordered to pay several thousands of dollars in restitution. If so, they would have taken money from money sent in and money earned toward the payment of the restitution amount.

@nakohichi, thanks for the reply. His lawyer told him that it is not a big deal, he just probably will not get to work so he can earn commissary money. I told him being able to earn money for commissary is a big deal.

@rewdiazepam, That's what I thought. I figured they would take a portion of his commissary money until the fee is paid. I know we are very fortunate, he was facing fines up to $750,000.

So, let me get this straight, when the Judge was talking and stating that my son had a restitution of $1000.00, they are taking it out of the money I send him to get stuff from the commissary? How much do they take out of the money sent? What a freaking rip off!!!! I thought this was something he would have to pay when he got out? I guess they want to make sure that you have money to pay for probation fees and S.O. classes so they get it out of you in there! What a joke!!!! This just really ticks me off! They use our loved ones to make money! Those people should be in jail!!!

In CA, they take 55% off the top for money placed on his account for canteen. Hubby tries to avoid buying much on canteen. He tries to maximize the money by getting stuff from his quarterly package because the state can't take any money on that.

If I remember, they took 20% a month from my Unicor pay and money sent in. The real rip off is they charge interest on the unpaid fees and fines until it is fully paid off.

The papers say no interest. As for restitution, the judge said there was no one to pay restitution too.
Personally, I think the judge did not impose all kinds of fines because he knows that even if my son lives long enough to get released, he will by then be on oxygen and unable to work.
