most likely yes. My pre trial officer (like a probation officer, before conviction) did my PSI and she was at a few of my court hearings.

Please forgive me as I am catchin up on terminology that I'm not used to be but What is a PSI??

PSI is a Pre-Sentence Investigation usually done by a probation or parole officer.

The PSI is just a record of the offender's education, medical, work, and a bunch of other histories the defendant has. If it is extensive, it is a history of the defendant's life.

It is just usually 20 or so pages long, or at least mine was. It is compiled and put together by a PO usually.

The victim, if there was a victim, will be asked to write a statement to put into the PSI and usually the defendant writes one out also. The victim's statement will be like a victim impact statement.

The PO fills out his portion of the report and he or she will make a recommendation with an opinion of a fair and just sentence.

The purpose is to determine if there are any aspects of the case that might mitigate the sentence. Of course, if the PSI is unfavorable, that could make the final sentence less favorable at sentencing.

Some judges see it as more a formality than anything and don't pay much attention to it, but I have read where a positive PSI has helped a offender at sentencing.

The one I saw in the court room is a personal friend and sings with my son in church. Very laid back, liberal, not what I expected when I heard Parole officers do these. This guy was arguing more for the defendant than her own lawyer was.i was just curious cause I thought the PSI individual was in so many words...law enforcement. .

The PSI is very important. Our lawyer didn't convey that to us and I wish he did.
They will recommend what the sentence will be. Your husband needs to make the best impression he can. And when he's released his PO has that report as well and may use it.

I' m guessing from Rew's response your mileage may differ, but it was important for my son.

The PSI is done after the conviction and before sentencing.

Obviously, if there is no conviction, there is no reason for a PSI, so that is why it is done after the conviction.

The PSI is presented before sentencing so the judge can get a better understanding of the accused's background and use that information to take into consideration at the day of sentencing.

Thank you. I guess I should ask my husbands attorney about his PSI then. He has a court date in the beginning of next month and I think that is when his attorney will give his evaluation to the judge if it's good. If it is not good, his attorney will not be turning that evaluation in. Then I have heard that the sentencing date after that is in early May( although I'm like 85% sure it will get pushed back again)

Is the PSI done by the current probation officer? Or another? Up until recently all has been pretty good with the current office but suddenly as we are nearing a trial it's become a poke and prod type conversation at every turn and smart comments and a real attitude. I'd rather it was someone without this sudden preformed notion (BTW they just had someone rig a device while on pre-trial and get away...so the whole department has taken a beating over that...which I suspect is where the issue is coming from rather than with my husband as a person and there've certainly been no problems)

In my county, all the PSIs for state charges were done by the local PO officer. There was only one or two POs in my county, but only one of them did the PSI.

I had not previous dealings with a PO, as I went to trial and was out on bond, so I did not know her at all. But I do know she was the PO for my county.
