Totally understand how you feel scaredmoman. In the very beginning I could not even find enough strength from within myself to even go to my son's court dates. I would send everyone besides myself. Finally I went and to get me through it, I focused not on the outward appearance of my son, with the shakles, the jumpsuit, the handcuffs. I instead looked at the man he was on the inside.

So they came back with another plea of 10 years with 85 his PD said that she isn't sure that the prosecutors wants to talk to my daughter but she would like to im not really sure she also would like my husband to get a pysh eval for them to say that he isn't at risk for reoffending and that she would hope will have the prosecutors lower his time she is aiming for 5 years with 85

I would not allow my daughter to talk to anyone in law enforcement, including the DA. They certainly do not have your husband's best interest in mind----trust me. They most likely will try to confuse your daughter and get her to say something that will dig a deeper hole for your husband.

They don't care about your daughter or your husband. They are ruthless and as deadly as a rattlesnake.

There might be people that will say she should talk to them and explain how she feels, that she does not want him prosecuted, etc. But it never works out that way. If law enforcement does anything well---other than lie--- it is manipulate witnesses and defendants to get them to say things they can twist to make it harder on the defendant.

Why not just counter that with an offer that your daughter will present the DA with a prepared statement? They will probably refuse that offer as that does not give them the opportunity to cross her up and make your husband look bad, but I would ask.

IF--IF--they don't want a statement, then you know that any "conversation" your daughter has with law enforcement is not in the best interests of your husband and that their motive was only to get your daughter to say something that would help their case. Don't ever underestimate law enforcement.

That psychological evaluation is VERY IMPORTANT. This is a report from an unbiased party who has no axe to grind. A good report will go a long way to ensuring a better plea deal. Judges particularly like reports from professional people who have no stake in the case and are credible.
