I thought the Bible Belt states had a monoply on unfairness and a lack of due process when dealing with sex offenders. Guess I was wrong.
Montana has passed a law where prosecutors (you know how unbiased and fair prosecutors will be) can review the cases and histories of undesignated sex offenders and re-evaluate them for possible inclusion on the state's tiered sex offender system.
Want to bet that most will be placed on Tier 3? Hell, they would put them on Tier 4 or 5 if they had such a designation.

It gives the prosecutors the ability to willy nilly put someone who was previously undesignated on a Tier level, WITHOUT ANY DUE PROCESS. No court hearing or no method for the registrant to defend himself.
The choice is purely at the DA's discretion. Scary isn't it?
Just another cog in the "get tough on crime" wheel. Prosecutors want to look like heroes and savious to the voting public so they can get re-elected. Then they can have another term of prosecuting..er, persecuting certain people who are either innocent and have committed only a minor crime.
It's just another tool they have to make this generation's whipping boy, the sex offender's, life miserable.
