Honestwitness that is exactly what my husband's lawyer told him. We all really know that plea bargains are no bargain, but 20 years versus 3 years 3 mo. is a no brainer. Accused, no evidence, prosecuted based on an accusation only - this is a clear example that innocence is not even considered in this crime. So the person is innocent but prosecuted with no evidence and depending on the age of the victim and the charges against the person may determine the level of sympathy of the jury. So the innocent person goes to trial is still found guilty based only on an accusation and no evidence which results in a horribly long sentence to serve. The only hope is to appeal and that could take a long time as well. Plea bargains do result in lesser charges. The stressors placed upon the family can be so great going through a trial (which will most probably not resemble the TV justice we dream of). Again, I say it is the personal decision of what each family wants to gamble on and deal with. There is no winning in this predicament for the accused. The accused is a powerless pawn and the players are the lawyers - blood thirsty carnivores out for the kill of a family.

I am new to this group. My husband is charged with 2 counts of indecent contact with a child. I know for a fact that he is innocent, but there is no way to prove it. We have a court appointed sorry excuse for a Public Defender. At my husbands pretrial, his PD gave us 10 minutes to decide if we wanted to A) go thru trial and get 4 years in prison with no possibility for getting out early with good behavior and registering for life...and then he told us that he wouldnt fight for us and that he feels my husband has a "problem" OR B) that we can take a plea agreement where my husband would serve his time concurrently and would either get 2 years probation or 2 years in prison but would be out in 11 months and 2 weeks with good behavior and would "only" have to register for 10 years.....and we were given exactly 10 minutes to decide. We decided to take the plea because it was a guarantee... a year in prison or 2 years probation. In reality, it was the lesser of 2 evils, both of which suck terribly. We wont know until November 10 which it will be, and if he is to be incarcerated, he will be lead away in handcuffs at sentencing. The hardest part of all is how are we going to tell our 6 year old son?(he is not the child accusing him of this) This is just an awful situation :(
