Once he is off probation----and only on the registry----you two can do whatever you want. He will no longer be in state custody with probation and he will have completed his court mandated sentence. His only restrictions will be those set forth by the sex offender registry.
There is no law in any state that tells him he cannot have a child with you once probation is over. Of course, he will have the restrictions of the registry and that may include residency restrictions, but he can have a child with you and both of you will be on legal ground.
After you have the child, there is a slight possibility that someone might file a complaint with CPS that a sex offender is living with a minor child, but I doubt it would go very far since the child would be his biological child. They could start an investigation, but as I said, I don’t think they can really do much about him being with you and the child unless there was some evidence that there was some child abuse going on. I am not sure how the CPS would look at your prior problems, though.
If you care about this guy, then I would have him ask the PO about you two being in a relationship. If the PO has no problem, then you are OK. I would probably not have any children until he is off probation.
If the PO refuses to allow him to live with you, then after his probation is completed, you two can get together, as there are no laws to prevent it.
But no matter if he is on probation or not, him being around your other child would not be a good idea.
If, once you are together and have a child, the CPS begins to give you problems, you can always have a psychosexual evaluation done on him. A positive evaluation done by a professional therapist, which shows he is no threat to children with a very low chance of reoffending would go a long way to keep the CPS off you, IF they cause problems.

In your situation, there are no children except your daughter, who is basically out of the picture the majority of the time. It sounds as if the PO will not have a problem with you and your guy marrying, so I say go ahead if you love each other. Later on you can have children and be a family.
