what a crock of bull. i've been seeing different comments on various sights talking about arresting people for the reason, that they might or may break the law in the future... wow!! i thought that it was a bunch of baloney. just goes to show ya just how wrong someone can be....

Public outcry is a big part of it.
To me this isn't any different to us applying there sentence. To me them doing this on just a maybe is stupid and not really good grounds for it.

I don't think there will be a different judge re-deciding the sentencing, so the prosecution is asking the judge to reconsider their own decision. I cannot imagine the judge is going to say, yes, I screwed up. This is hopefully a non story.

I am going to play devils advocate here... This is the appeals process. If either side decides they don't like the outcome they are entitled to appeal... Doesn't matter the side....

We don't know the facts of this case, we don't know the transcripts of what the judge said about their decision. For all we know they had good reason to lay down the sentence they did. For all we know this prosecutor is up for re-election this fall and is trying to make a name for themselves in their track record of putting away CP offenders. We just don't know... My guess is that the plea agreement that was made had incarceration on it and the judge didn't follow that... so the DA wants 'justice' for that... heh

I believe he is up for reelection this Fall. Chester County is right outside Philly.
However, this statement is pure BS! "Moreover, child pornography is the gateway to child sexual abuse and child sex trafficking." I hope the Defense jumps all over it if it goes to appeal.

I have often stated that the War on Drugs has morphed into the War on Child Pornography. They government is using the same tactics and misinformation in their propaganda campaign to demonize those accused of crimes.

I said "misinformation" as I wanted to be generous, but the proper word would have been "lies."

In the War on Drugs, all we heard was "marijuana use is the gateway to stronger drugs such as heroin." In the War on Child Pornography, all we hear is that "child pornography is the gateway to child sexual abuse."

Neither statement is necessarily true, but propaganda is rarely based on truth.

There are many, many parallels in these two so-called wars.

I'm not a cop, nor do I know any cops who investigate sex abuse, but I would imagine if you arrested someone for sex abuse or rape or something like that, wouldn't you check their computer for CP? If their is a link between the two you'd think the police would be able to show ample evidence of it right?

Yes, some heroin addicts did indeed start with marijuana, but that does not mean smoking marijuana will lead to a heroin addiction.

Yes, some people who rape and abuse children do have an interest in child pornography, but not everyone who looks at child pornography will become a child abuser.

The people who evolve from marijuana users to heroin addicts do not progress in this manner because they used marijuana. No, they have progressed to harder drugs because they have an addictive personality or have events in their life that cause them to seek out harder substances. There is nothing magical in marijuana by itself that causes a person to become addicted to heroin.

The people who once viewed child pornography and now abuse children have evolved into perverts because of some psychological or pathological defect in their personality or makeup. The fact that they began with child pornography had nothing to do with them progressing to child abuse. There is not something magical in child pornography that caused them to progress to molesting children.
They would have most likely molested and sexually assaulted children even if they had never viewed child pornography.

The people who do not understand this just do not understand drugs or mental disease processes.

Nobody that has any higher education or common sense believes any of the nonsense that the DA in that article was spouting.

The theory that "viewing child porn is a gateway to child abuse or rape" has never been confirmed by any medical studies I have ever seen. This observation---propaganda--- is only used by politicians, prosecutors, or victim rights groups when they want to further their cause.

What cause? Prosecutors use it to get convictions which keeps their conviction rate high. Politicians use it to pass these ridiculous, restrictive laws and victim rights groups use it for funding purposes and to enhance their cause in the eyes of the public.
