Anybody know relevant case law or is this (much like Tier decisions) left up to the majesty of Prison and Parole departments. (In NV a prisoner has to stay in prison with a parole in hand to fight his tier classification but the prison/ parole board will revoke his parole while in prison IF he remains in prison 1 year (fighting his classification) after receiving his parole? Sort of a catch 22. "You can object to whatever but only upon these catch-22 conditions?
From stories I hear, it seems that Petitioning to get off the Registry might have similar hidden mouse-traps depending on the state you are in?
I would also like to see the possibility to argue that since the "list" itself is causing so much harm to a particular family/ in a particular that might be grounds to petition and be released from the "List" Just to be supervised 'privately' instead of being Googled publicly might be a great relief to spotlighted/ endangered families suffering actual documented collateral damage?
So then the question must be how to mitigate the damages that lists elicit. To make them not publically accessible and only LE accessible would be a start. It isn't like you can look up someone SS# on an online database. Same with Drivers license numbers, they are not publically available either.
What I know about Wisconsin is that in some cases there are no remedies. If you have been sentenced to life on the registry because of the statute of conviction then there is no petitioning, not even after 20 years when it comes to registration. Now for lifetime supervision and GPS there is a 20 year mark where you can petition the court for release from those things.
Personally I would like to see the whole thing abolished or after 15 years on the registry everyone drops off. If they haven't committed another crime in 15 years they are unlikely to and it is no reason to punish everyone for the 1 or 2 that might be patient and waiting for their time to be up to reoffend. But those two do not give reason to punish 700,000.
I'd like to hear the arguments of the opposition but would like them to answer the questions that are posed with verifiable facts rather than hot air. Also giving us an opportunity to cause them to critically think and be objective. Because as we know those monopolizing victims that see an opportunity to forward their careers and futures get lots of press. Mark Lundsford, what's-her-face and her father continually running for office on the shoulders of his daughter. They come in all shapes and sizes but their M.O. seems to be the same.
I have never had a homeless person approach my car unless I indicate it is ok and never have they gotten aggressive with me or tapped on my window - and just so you know Hunt Club is a very rich neighborhood

Now I've recognized some folks here that hang out on different corners.... Walmart, Sams, Costco, where ever richer folks go and they get money every red light. Many folks here are homeless by choice (or act homeless.) and disappear when it gets colder but return in the spring.
When working my community service at a food shelf I knew a lot of the clients.
I'm not saying there aren't legitimate homeless but there are people who game the system.

Many are RSOs
Many are mentally incapacitated
Many are families that have lost everything
Just like with RSOs there are the "bad" ones but we do not want to be judged by them or thought of all in one lump so I try not to do that about the homeless - also I believe something my father always told me "... It is not about what THEY do but instead about what YOU do." When I was a teen that irritated the crap out of me (lol) but now I understand the full meaning of it.
I have had people tell me that they go buy booze etc....and I say if I had to sleep in the FL woods every night I would get drunk too! lol
I would venture to guess that the players among the homeless are the few ...
