Coastie- thanks for the link. I read all about the special sentence and how or why he got it makes more sense now. It still boggles my mind he has lifetime supervision and lifetime registration for his charge when so many don't for the same charge or an even more serious offenses. IDK just hard to understand the logic behind some situations I guess. Does anyone have any actual personal experience with a situation like mine?

Are you sure that's lifetime parole? or just lifetime registration? They don't see registering as a sentence or punishment, it's just there to protect the community or something like that. Anyways, you can always move to another state once his sentence ends, one that does not require lifetime registration.

Registered, once you are on a registry for Life, you can never be removed, even if you move to another state. The law states that if a person moves, you have to abide by the term limit from the state you were convicted, or the new state which you reside, whichever is longer. This was done as many were doing just as you suggested. States with less stringent SO laws we're attracting SO's from stricter states, so this was done to help curb that.

Yes, it is a federal law. You can look at multiple posts where Rew and others have said, if you are off the registry in your state - don't move! Because, if you move, you can be placed back on the registry. If you visit FL, and stay more than 48 hrs, you are on the registry FOR LIFE.

my state already confirmed in paper writing that I would be allowed off the registry once the requirements were met, and my offense actually occurred in Florida (I live in another state), yet according to my state I am not required to register FOR LIFE, so I'm not sure who to believe... In fact, I was considering moving to another state soon.

My son was sentenced and spent time in Federal prison. When he was released I was waiting at the door to bring him home to PA. IF he stayed more than 2 days he would have had to register there and he would be lifetime on the registry. But, since he only spent 4 hours free there and came right up here to PA he didnt.

If you are off the registry in your state, you had better stay right where you are. Here is one of my previous posts to help clarify why-------

If you are ever removed from the list and no longer have to register in one state, you had better remain in that state and never establish residence in another state.

If you move to another state you will have traveled in Interstate Commerce, which makes you subject to a Federal requirement to register. This is part of the federal SORNA act passed in 2006.

Two well qualified attorneys have mentioned this to me, one of whom was the appellate attorney in the Starkey case in Oklahoma.

Here is John Dunn's site. He is the attorney who represented and won the Starkey case here in Oklahoma. He mentions this scenario about half way down the page under the question "Does the federal law apply to me?"

The fact is that even though you do not have to register in one state, when you move you will be subject to register in the state you are moving to.
This is one of the provisions of SORNA.

I am no longer on the registry here in Oklahoma and I am not about to move and test this theory of being subject to a federal requirement to register---SORNA---by engaging in interstate commerce by the moving.

I mention this because many people think once they are off the registry, they are off the registry everywhere. That is no longer true as of 2006, when SORNA was enacted.

The reason I always mention this is that I do not want any of my fellow registrants and friends to be removed from the registry and then move to another state only to have Federal Marshals knocking on their door wanting to arrest them for Failure to Register.

I seem to remember reading somewhere that prisoners are now being registered while still in prison in some states?

That happened to my son. His pic was on the registry within a week or two after being locked up.

Well, I am not actually off the registry in my state, and I have already moved to a different state (from FL) in Feb 2005, possibly preempting this SORNA requirement? Are you suggesting that by moving to another state, I will trigger the lifetime requirements of FL?
