This article goes back and forth to me - are they saying it probably will be ruled unconstitutional or not? lol

They did not really give a concrete opinion of his chances of winning the case, but I don't think it will apply to cases where someone is on paper time.

Notice it says the "involuntary" use of the GPS. People on probation have agreed to be on the GPS as terms of their probation, have they not? If I am wrong, please someone come in here and correct me as I was never on probation.

But this article and the law suit if he wins is a step in the right direction.

Thanks for the article Rew. My guy is wearing a GPS involuntarily as it was never court ordered, and he never consented to it. He was simply told by the PO that he would have to wear one, and that it was the law. Well, it is the law to a certain extent only. I can go into detail later, but the bottom line is that the court did not order it. No attorney seems to want to fight this as the standard answer is: They (the PO) can do whatever they want. I don't really think that can be true.

That happened to my son as well. He was never told by his lawyer, the judge, or anyone anything about the sex offender restrictions and probation requirements. After adjudication I toke him to the PO office and he called from inside panicked because he said Mom they are going to put a monitor on me! It was heartbreaking
